העותר יליד שנת 1973 מצוי במעצר מנהלי המוארך מעת לעת, פרק זמן ממושך – מאז חודש דצמבר 2007. עיינו, בהסכמת העותר, בחומר החסוי שבידי המשיב ושוכנענו כי יש בסיס לחשד כי העותר פעיל חמאס המסכן בפעולתו את בטחון האזור. לא מצאנו לפיכך עילה להתערב בהחלטת המשיב. עם זאת רשמנו לפנינו את דברי נציג המשיב שהשיב לשאלתנו ואמר כי עובדת משך המעצר תובא בחשבון בעת שישקל בעתיד הצורך בהמשך המעצר. עם זאת יצויין כי נציג המשיב הודיענו כי בכוונתו להאריך את המעצר בתום תקופת המעצר הנוכחית.

העתירה נדחית. אין צו להוצאות.
