פסק-דין

1.ביום 29.6.2014 החלטנו להוציא צו על תנאי לפיו נדרשה המשיבה 1 ליתן טעם מדוע לא יועבר המשיב 2 מתפקידו כמנהל בפועל של חטיבת החדשות בטלויזיה. בד בבד הוצא צו ביניים שאסר על המשיב 2 למלא את התפקיד הנזכר וזאת עד להכרעה בעתירה. ביום 23.7.2014 הודיע המשיב 2 בכתב לבית המשפט כי מסר למנכ"ל המשיבה 1, הוא המשיב 3, שהחליט לסיים את תפקידו כמנהל בפועל של חטיבת החדשות וכי מקובל עליו שדרך המלך לקבלת עובדים ברשות היא באמצעות מכרז. בהודעה נאמר כמו כן כי המשיב 2 סבור שבנסיבות אלה התייתרה העתירה. בהודעתו לבית המשפט ביקש המשיב 2 כי ייפסקו הוצאות לטובתו.

המשיב 2 צירף תגובה מטעם העותרות להודעתו. בתגובה נאמר כי לאור הנסיבות החדשות יש למחוק את העתירה תוך שהמשיבים 2 ו-3 יחויבו בהוצאות לדוגמה.

2.נוכח הודעתו של המשיב 2, ראוי אכן למחוק את העתירה. הודעתו של המשיב 2 משמעה כי העתירה השיגה את מטרתה. על כן, ראוי לפסוק הוצאות לזכות העותרות ולחובת המשיב 2, אם כי בסכום מתון. זאת נוכח הנסיבות ובין השאר מאחר שהודעתו של המשיב 2 ניתנה זמן קצר לאחר שהוצא צו על תנאי וזמן רב לפני הדיון בתשובה.

העתירה נמחקת איפוא. המשיב 2 יישא בשכר טרחת עורך דין בסכום של 4,000 ש"ח ובאגרת העתירה.
