1.פחות מיממה לאחר פרסום דו"ח הביניים של הוועדה לבדיקת אירועי המערכה בלבנון 2006 – ובפנינו עתירה להורות לראש הממשלה לנמק מדוע לא יודיע לאלתר על התפטרותו מתפקידו נוכח המסקנות שנקבעו לגביו בדו"ח זה. בעתירה, שהגיש עורך-הדין יוסי פוקס, מובאים דברים קשים שאמרה הוועדה בענינו של ראש הממשלה, אשר דומה כי מאז ליל-אמש מוכרים הם וידועים לכל.

2.טיעונו המרכזי של העותר הוא, כי נוכח כך שמבחינה מהותית אין כוחה של ועדת וינוגרד נופל מזה של ועדת חקירה ממלכתית, הרי הפועל היוצא של מסקנותיה לא יוכל להיות שונה מזה שהקימו מסקנותיהן של ועדות חקירה ממלכתיות בעבר. להשקפתו של העותר, קנו להם ממצאיהן של ועדות אלו מעמד נורמטיבי, שיש בו כדי להכפיף את שיקול דעתם של בעלי התפקידים הרלוונטיים לאמות מידה של אתיקה ציבורית ופוליטית, המחייבות – כאפשרות יחידה ואין בלתה – חדלות מכהונה.

3.תימוכין לעמדתו מוצא העותר בדברים שכתב פרופ' י' זמיר, בעקבות מסקנותיה של ועדת כהַן שלאחר מלחמת לבנון הראשונה, ולפיהן – כך להבנת העותר – מסקנותיה של ועדת חקירה אינן מותירות לגורמים המבוקרים שיקול דעת אם ליישמן ואם לאו, ומבחינה זו הוועדה כמוה כ"וועדת משמעת" (י' זמיר "ועדת החקירה מן הבחינה המשפטית" הפרקליט לה (תשמ"ד) 323, 329). חיזוק נוסף לטענתו נמצא לעותר בכך, כי בניגוד למסקנות המופנות כלפי בעלי תפקידים מיניסטריאליים – אותם מוסמך ראש הממשלה להעביר מתפקידם – הרי לגבי ראש הממשלה עצמו אין הדין כולל מנגנון מנהלי, המאפשר העברה מכהונה. הדרך היחידה ואין בלתה, אותה חייב על-פי הטענה ראש הממשלה לנקוט, היא זו הקבועה בסעיף 19 לחוק יסוד: הממשלה, דהיינו, התפטרות יזומה. המשך כהונתו של ראש הממשלה, מוסיף העותר, נגוע בחוסר סבירות קיצוני, המחייב את התערבותו של בית-משפט זה. ועוד: על אף הלשון המפורשת אותה נקטה ועדת וינוגרד, ולפיה תימנע לעת הזו מניסוחן של המלצות אישיות היות שאין זה רצוי "שנחליף את שיקול דעתם של אלה המופקדים על החלטות אישיות בשיקול דעתנו" (עמוד 25 לדו"ח הביניים), הרי, לטענת העותר, האמור בדו"ח הוא כה חמור עד כי נהיר שהוא מייתר את הצורך בקביעתן של המלצות אישיות. ולבסוף, מעיד העותר על עצמו כי "אין בידו לעשות מאומה זולתי פנייה לבית משפט זה" (פסקה 31 לעתירה).

4.לאחר שעיינו בעתירה ובנספחיה, באנו לכלל מסקנה כי העתירה אינה מגלה עילה להתערבותנו ודינה להידחות על הסף. מ דובר בדו"ח ביניים שהונח אתמול על שולחן הממשלה ומטבע הדברים עודנו נלמד על ידי כל הגורמים הנוגעים בדבר. יותר מכך, העותר אף לא פנה לראש הממשלה בעניין זה. האופן בו בחר או יבחר בעתיד ראש הממשלה להתמודד עם ממצאים שנקבעו בענינו האישי בידי ועדת הבדיקה הממשלתית, הוא ענין מורכב ורגיש מאין כמותו. יסודו העיקרי הוא "בשאלה פוליטית מובהקת" – כדברי פרופ' זמיר במאמרו הנ"ל (שם, בעמ' 323). שכן, לכל ברי כי לאופן בו ינהג ראש הממשלה תהא השלכה עמוקה, ישירה ומידית על מערך הכוחות השלטוני במדינת ישראל, ואפשר שאף על זה המפלגתי. ככזו, הצביון העיקרי שעוטה עליה הסוגיה בה נקראנו להכריע אינו משפטי, ומוטב כי תונח לעשייתם של הכלים ושל המנגנונים בהם מצוידת שיטתנו הדמוקרטית, וכוונתי היא בראש ובראשונה למשפט הציבור ונבחריו. דומה, כי לדבר זה ממש כיוונה גם ועדת הבדיקה, בהחלטתה שלא לכלול בדו"ח הביניים המלצות בדבר עתידם האישי של הגורמים המבוקרים.

5.אעיר, כי ממאמרו של פרופ' זמיר ממנו מביא העותר, נשקף דווקא ספק באשר לקיומה של חובה משפטית ליישם את המלצותיה של ועדת חקירה. וכך נכתב שם:

"חוק ועדות חקירה, המסמיך ועדה כזו לתת המלצות, אינו מקנה להן תוקף מחייב. המלצה אינה פסק-דין, שחובה מוחלטת לציית לו, אלא כמוה כעצה. ...אין חובה משפטית לקבל את העצה, אך גם אין רשות להתעלם ממנה. החובה להתייעץ פירושה חובה לשקול את העצה לגופו של ענין ובכובד ראש... וזהו, ככל הנראה, אף תוקף ההמלצות של ועדת חקירה מבחינה משפטית. בחשבון ארוך טווח אף אין זה רצוי להקנות להמלצות של ועדת חקירה תוקף מחייב. אם תיקבע חובה מוחלטת לקבל המלצות כאלה יתווסף עוד גורם מרתיע מפני החלטה להקים ועדת חקירה. גם מבחינה עקרונית ראוי כי האחריות להחלטה תישאר בידי הממשלה, והממשלה תהיה חייבת לתת דין וחשבון על החלטתה בפני הכנסת ובפני הציבור". עם זאת, לכל ידוע כי משפטנו המנהלי התפתח והרחיב יריעתו במידה ניכרת בקרוב למחצית היובל שחלפה מאז נכתבו דברים אלה. אף פרופ' זמיר, באותם דברים, אינו שולל את האפשרות כי בית-המשפט הגבוה לצדק יידרש לבחון כלום נגועות החלטות הממשלה באשר למסקנותיה של ועדת חקירה בשיקולים זרים ואין הן עניניות (שם). על כן, ומבלי לקבוע מסמרות משפטיים מקום בו אין הדבר נדרש, אעיר כי איני רואה הבדל של ממש בין החלטות ממשלה, שענינן יישום מסקנותיה של ועדת חקירה בתחום המקצועי-אופרטיבי לבין כל פעולה מנהלית אחרת, אשר אין ספק כי נתונה היא לביקורת שיפוטית. אולם, לא בהכרח דינן של החלטות מעין אלו, כדין החלטות שיסודן הוא פוליטי במובהק, ומכל מקום – שאלה זו יש להותיר לשעתה.

6.נוכח כל האמור, סברנו כי אין להידרש לעתירה זו, ואנו דוחים אותה על הסף.
