השופט ס' ג'ובראן:

עניינה של העתירה שבפנינו הוא בטענת העותר, כי יש למחוק כתב אישום פלילי שהוגש נגדו בתיק פלילי מס' 2928/06 בבית-משפט השלום בתל-אביב-יפו (להלן: התיק הפלילי) ולהעביר את הדיון מבית-משפט השלום לבית הדין למשמעת של עובדי המדינה. העותר טוען, כי הופלה לרעה על-ידי המשיבה 2. עוד טוען העותר, כי המשיבה 2 הגישה לבית-משפט השלום חומר ראיות בניגוד להוראות סעיף 142 לחוק מס ערך מוסף, התשל"ו-1975 ובסטייה מצווי האזנות סתר, אשר ניתנו על-ידי בית-המשפט המחוזי.

לאחר קיום דיון ביום 29.11.07 בפני בית-משפט השלום (כבוד השופטת ד' שריזלי) החליט בית-משפט השלום, ביום 15.1.08, בין היתר, כי לא מצא בסיס לקביעתו הנחרצת של העותר, כי הרשויות, קרי: ראשי אגף מכס ומס ערך מוסף, המשטרה והפרקליטות, נהגו בו התנהגות נפסדת, שרירותית או מתעמרת. וכך קבע:

"...הטענות שהועלו לגבי "רדיפת" הנאשם ע"י העומדים בראש אגף מכס ומע"מ, לגבי "סימונו" כמועמד להדחה, ולגבי בידוי זדוני של מידע מפלילי עליו, כולן טענות סתמיות, מעורפלות וכוללניות; כולן אינן אלא הטחת האשמות חמורות בבעלי תפקידים בכירים במכס ובמשטרה, שאין עמן אחיזה ראייתית....

אמירות סתמיות מעין אלה אינן יכולות בשום אופן לשמש בסיס לקביעה בדבר היותו של הנאשם מושא לרדיפה והתעמרות."

ביום 14.5.08 הגיש העותר לבית-משפט זה את העתירה שבפנינו, בה הוא טוען, כאמור, כי יש למחוק כתב אישום פלילי שהוגש נגדו בתיק הפלילי ולהעביר את הדיון מבית-משפט השלום לבית הדין למשמעת של עובדי המדינה.

מנגד, מבקשת באת-כוח המשיבה 2 לדחות את העתירה על הסף ולחייב את העותר בהוצאות, כשעיקר טענתה הוא, כי הדרך הרגילה והמתאימה להעלאת טענותיו של העותר הינה בבית-המשפט הפלילי הדן באישום.

דין העתירה להידחות על הסף.

טענותיו של העותר בעתירה הועלו בפני בית-משפט השלום במסגרת התיק הפלילי המתנהל נגדו. בנסיבות אלה, למעשה מבקש העותר מבית-משפט זה להתערב בהחלטת ביניים שניתנה בהליך פלילי.

ברם, כידוע, הלכה היא, כי בית-משפט זה בשבתו כבית-משפט גבוה לצדק לא יתערב בהחלטות ביניים של ערכאות משפטיות וביניהם בהחלטות ביניים במסגרת הליכים פליליים. לאחר שיינתן פסק-הדין בבית-משפט השלום, יוכל העותר, אם יחפוץ בכך, להשיג על החלטות הביניים במסגרת הגשת ערעור על פסק-הדין כולו.

בית-משפט זה קבע לא אחת, כי הלכה היא, כי התערבות בהחלטות ביניים בהליך פלילי שמורה אך למקרים נדירים, בהם מתעוררת טענה של חוסר סמכות, או למקרים קיצוניים של הפעלת שיקול דעת שרירותי בעניינים מינהליים טהורים. כן נקבע, כי טענה כנגד החלטת ביניים אשר ניתנה בהליך פלילי מקומה להתברר, בדרך כלל, רק לאחר שנסתיים אותו הליך ובמסגרת ערעור על פסק-הדין אשר ניתן בו. כך למשל, נקבע בבג"צ 2484/04 ארכדי ניסנביץ נ' הרכב בימ"ש מחוזי בראשות השופט צבי סגל (לא פורסם, 14.3.2004):

"כידוע, אין בעל דין זכאי לערער על החלטות ביניים הניתנות במסגרת הליכים פליליים (למעט חריגים ספציפיים). בית משפט זה חזר ושנה, כי לא יתערב בהליכים פליליים המתנהלים בפני בתי המשפט הרגילים אלא במקרים חריגים ונדירים, בהם מועלית טענה ממשית בדבר חוסר סמכות או מתגלית תופעה קיצונית של שרירות בתחום שהוא מינהלי... משכך, דינה של העתירה להידחות. באם יורשעו העותרים בסופו של ההליך יוכלו הם להשיג, כמובן, על ההחלטות נשוא עתירה זו בפני ערכאת הערעור."

עניינו של העותר אינו נמנה על המקרים האמורים לעיל ולכן אינו מצדיק התערבותו של בית-משפט זה. ברי, אפוא, כי באם טענותיו של העותר לא תתקבלנה בבית-משפט השלום, יוכל העותר לטעון טענותיו בפני ערכאת הערעור.

אשר-על-כן, העתירה נדחית על הסף.
