פסק-דין

1.שמענו טיעונים מפי פרקליטיהם של בעלי הדין. נראה לנו כי דינן של שתי העתירות להימחק.

2.בכל הנוגע לעתירה בבג"ץ 430/12, התברר כי חלו התפתחויות שונות במישור התכנוני מאז הגשת העתירה. לפיכך יש למחוק את העתירה והעותרים יוכלו להגיש עתירה חדשה שתכלול התייחסות, בין היתר, להחלטות החדשות שנתקבלו על ידי גופי התכנון. הצו הארעי שניתן ביום 15.1.2012 יפקע בתום 90 ימים מהיום.

3.אשר לעתירה בבג"ץ 1556/12: בעתירה זו מלינים העותרים על בנייה בלתי חוקית. בעתירה הוצא צו ביניים שאסר בנייה. לטענת העותרים צו הביניים הופר. בא כוחם של המשיבים 3-1 הצהיר בפנינו כי אם יתברר שאכן צו הביניים הופר, הרי הריסה של המבנים תעמוד בראש סדר העדיפות לעניין אכיפה. משניתנה הצהרה זו אין מקום להותיר את העתירה על כנה. כמובן שעל המשיבים 3-1 לפעול בזריזות המתבקשת על מנת לברר אם אומנם הופר צו הביניים שנתן בית משפט זה, ואם הופר עליהם לבצע את ההריסה. צו הביניים שניתן ביום 7.6.2012 יפקע בתום 90 ימים מהיום. ממילא שמורות לעותרים כל טענותיהם.
