השופט י' עמית:

1.מידי שנה יוצאים מהשטחים לחוץ לארץ דרך גשר אלנבי כ-700,000 איש תושבי האזור. תושב האזור המבקש לדעת מראש אם קיימת נגדו מניעה ביטחונית אשר תמנע את יציאתו לחו"ל, רשאי לפנות מבעוד מועד למינהל האזרחי –באמצעות הקישור הפלסטיני או ישירות באמצעות המת"ק (מינהלת התיאום והקישור) הגזרתי - ולקבל תשובה אם קיימת מניעה כאמור. תושב שנמסר לו כי קיימת מניעה בטחונית ליציאתו, רשאי להגיש השגה אשר תועבר לבחינת גורמי הביטחון ותיענה בתוך פרק זמן של שמונה שבועות. הבירור המוקדם מעוגן ב"נוהל טיפול בבקשות תושבים פלסטינים לבירור קיום מניעה בטחונית ליציאתם לחו"ל ולהסרתה" של המינהל האזרחי לאזור יהודה ושומרון (להלן: הנוהל). הנוהל גובש בעקבות עתירה קודמת שהוגשה על ידי העותרים (בג"ץ 8155/06 האגודה לזכויות האזרח נ' מפקד כוחות צה"ל ביהודה ושומרון). הנוהל הוצג בפני בית משפט זה בבג"ץ 8155/06 הנ"ל, וביום 21.2.2012 ניתן פסק דינו של בית משפט זה כלהלן:

"1. עיון בהודעת המדינה מיום 11.2.2010 מעלה כי סעיף 5.ה. לנוהל המתוקן שונה כך שמשך התקופה האמורה בו קוצר משנה לתשעה חודשים בלבד. עוד עולה מהודעה זו, כי תושב פלסטיני שייפנה למפקדת התיאום והקישור הישראלית יקבל על אתר תשובה האם עומדת נגדו מניעה ביטחונית, אם לאו.

2.נוכח האמור בהודעת המדינה לעיל, הודיעו העותרים ביום 19.2.2010 כי לא יעמדו עוד על בירורה של העתירה וכי נכונים הם למוחקה, תוך שמירת זכותם לפנות ל בית המשפט בעתיד.

3.בנסיבות אלה, אנו מורות על מחיקת העתירה, תוך שמירת זכותם של העותרים לשוב ולפנות ל בית המשפט בעניינים פרטניים הנוגעים לנוהל ככל שיהיה בכך צורך בעתיד".

2.בעקבות מספר מקרים בהם נמנעה יציאתם של תושבי האזור לחו"ל במעבר הגבול בגשר אלנבי, למרות שבהליך הבירור המקדים נמסר להם כי לא קיימת מניעה בטחונית ליציאתם, ולאור עתירות פרטניות שהוגשו בשל תקלות אלה והערות בית משפט זה על הצורך למנוע תקלות מעין אלה (ראו, לדוגמה, בג"ץ 7498/10 ג'ואריש נ' המפקד הצבאי (לא פורסם, 3.11.2010)), גובש בחודש מרץ 2011 תיקון לנוהל. על פי הנוהל המתוקן, נקבע כי מקום שלא מוזנת למחשב מניעה בטחונית בעניינו של תושב שפנה לבירור מקדים, תועבר הבקשה לבחינת גורמי הביטחון והתשובה הסופית תינתן לאותו תושב טלפונית תוך 4 ימי עבודה. מקום שמוזנת במחשב מניעה בטחונית, תינתן לתושב הפונה תשובה על אתר, וככל שהוא מבקש לתקוף את ההחלטה בעניינו, עליו להמשיך ולפנות במסלול השגה (להלן: הנוהל המתוקן).

3.כנגד הנוהל המתוקן הוגשה העתירה דכאן, במסגרתה עתרו העותרים להורות על ביטול הנוהל המתוקן, ולהורות כי לתושבים הפונים לבירור מניעת יציאה לחו"ל יימסרו בו במקום תשובות נכונות ומדוייקות בהתאם למידע הקיים אצל המשיבים באותה עת. בעתירה נטען, כי הנוהל המתוקן הפך את הבירור לנוהל "דו שלבי", מה שמקשה על התושבים אשר פונים לבירור מוקדם אם קיימת מניעה ליציאתם לחו"ל.

4.בתשובתם לעתירה עמדו המשיבים על הדרך הארוכה שהובילה לגיבושו של הנוהל המקורי, ולאחר מכן לגיבושו של הנוהל המתוקן. לטענת המשיבים, הנוהל המתוקן הוא הרע במיעוטו, ונועד למנוע מצבים מביכים, כפי שארעו בעבר, כאשר בשל טעות נמסר לפונה כי לא קיימת מניעה ליציאתו לחו"ל, אך בעת שהגיע לגשר אלנבי נתברר כי לא כך הדבר. במענה לשאלותינו במהלך הדיון, הבהירו המשיבים כי מסופי המחשב במת"ק מסונכרנים עם מסופי המחשב בגשר אלנבי, אלא שהתשובות השגויות שניתנו קודם לתיקון הנוהל, מקורם במרבית המקרים בטעויות אנוש בגינן לא הוזנה המניעה הבטחונית במערכת הממוחשבת, או בחלק קטן מהמקרים, בשל הצורך בעריכת בירור נוסף.

5.לאחר ששמענו את הסברי המשיבים, נחה דעתנו כי אין מקום להתערבותו של בית משפט זה.

אכן, על פי הנוהל המתוקן, התשובה לגבי מי שלא קיימת מניעה בטחונית לגביו אינה ניתנת על אתר, כפי שנקבע בנוהל המקורי, אלא ניתנת טלפונית בחלוף ארבעה ימי עבודה. אולם, מנגד, על פי הנוהל המתוקן נמנעות התקלות שארעו בעבר, כאשר נמנעה יציאתם של תושבי האזור במעבר הגבול למרות שבבירור המקדים נמסר להם כי אין מניעה ליציאתם. ספק אפוא אם הנוהל המתוקן מרע את מצבם של תושבי האזור, ומכל מקום, הנוהל המתוקן אינו חורג ממתחם הסבירות באופן המצדיק התערבות בית משפט זה.

6.בשולי הדברים אעיר, כי לטעמי יש בכתב העתירה משום הטעייה של הקורא. העתירה פותחת בקריאה ל בית המשפט לקבוע דיון דחוף בעתירה בהיותה "נוגעת למאות אלפי אנשים הנוסעים מידי שנה מהגדה לחו"ל דרך גשר אלנבי". בהמשך מוסבר כי הנוהל המקורי "נועד לאפשר למאות אלפי פלסטינים הנוסעים לחו"ל מידי שנה, דרך גשר אלנבי, לברר מראש במת"ק הגזרתי האם המשיב 1 מונע את יציאתם לחו"ל". בסעיף 3 מתבקש צו ביניים בטענה כי הנוהל המתוקן נעשה בניגוד להצהרות המשיבים בבג"ץ 8155/06 הנ"ל "תוך פגיעה במאות אלפי אנשים". בסעיף 43 לעתירה מוסבר כי היא נוגעת להליך שיצרו המשיבים "על מנת לאפשר למאות אלפי פלסטינים לממש את זכותם הבסיסים לצאת את ארצם". בסעיפים 79-78 לעתירה מציינים העותרים כי הנוהל המקורי נוצר "על מנת להפחית את הפגיעה שנגרמת מהמצב הפסול, שמנע ממאות אלפי אנשים, המבקשים לממש את זכותם ליציאה מן הארץ ואת הזכויות הכרוכות בכך, לעשות זאת. והנה, השינוי בנוהל מרע את מצבם של כל אותם אנשים" (הדגשות הוספו-י.ע.).

הקורא לתומו בעתירה, יכול לסבור כי כל מאות אלפי תושבי השטחים שיוצאים לחו"ל דרך גשר אלנבי נדרשים לנקוט בנוהל בירור מניעה ליציאה מהשטחים. ולא היא, וכדאי שנשים נגד עינינו את המספרים בהם מדובר. על פי נתוני המשיב, שהעותרים אינם חולקים עליהם, מידי שנה יוצאים כ-700,000 איש מהשטחים לחו"ל. מתוכם פנו במהלך כשמונת החודשים הראשונים של שנת 2011 רק 163 תושבים בבקשה לבירור מקדים, ומראשית שנת 2012 ועד ליום 15.4.2012 הוגשו 38 בקשות לבירור מקדים כאמור. דהיינו, העתירה נסבה על 250-200 בקשות בשנה, המהווים כשליש הפרומיל מכלל תושבי האזור היוצאים לחו"ל.

דומני כי יש במספרים אלה כדי לשים את העתירה ואת הטענות הגורפות בדבר פגיעה בזכות התנועה של תושבי האזור בפרופורציה הראויה. הנה כי כן, 200-250 איש בשנה מתוך 700,000 איש, אמורים להמתין עד ארבעה ימי עבודה לקבלת תשובה סופית בטלפון אם קיימת מניעה בטחונית לגבי יציאתם לחו"ל. למעשה, מדובר במספר נמוך בהרבה, מאחר שהפונים לגביהם מוזנת מניעה בטחונית במחשב, מקבלים תשובה על אתר על פי הנוהל המתוקן. כך, לפי נתוני המשיב, מתוך 163 בקשות שהוגשו בשמונת החודשים הראשונים של שנת 2011, ב-152 מקרים ניתנה תשובה על אתר כי קיימת מניעה בטחונית, כך שרק ב-11 מקרים נאלצו הפונים להמתין ארבעה ימי עבודה נוספים עד לקבלת התשובה הסופית. נתון דומה עולה מהרבע הראשון של שנת 2012. מכאן, שהעתירה על ניסוחיה הדרמטיים, רלוונטית לסדר גודל של כעשרים איש בשנה מתוך 700,000 תושבי האזור היוצאים מדי שנה לחו"ל. לכך יש להוסיף את הצהרתם של המשיבים בפנינו כי מקרים דחופים ייענו בזמן קצר יותר מארבעה ימים. מספרים אלה, מדגישים מזוית נוספת, כי הנוהל המתוקן עומד במבחן הסבירות.

7.סופו של דבר, שדין העתירה להדחות. העותרים ישאו בהוצאות המשיבים בסך 5,000 ₪.
