א. עניינה של עתירה זו בהחלטת בית משפט השלום בכפר-סבא (השופטת רג'יניאנו) לשמוע עדי תביעה במשפטו של העותר (ת"פ 1101/07) בהיעדרו, כיון שהעותר לא התיצב לישיבה שנקבעה לשמיעת העדים הללו.

ב. שני כתבי אישום הוגשו כנגד העותר ביום 29.1.07; זאת לאחר שכתבי אישום דומים נמחקו "מחוסר איתור" (ת"פ 2467/05 ות"פ 2120/06). העתירה נסבה על הדיון בכתב האישום ת"פ 1101/07, בו יוחסו לעותר עבירות של החזקת נשק (קלצ'ניקוב ואקדח) ללא רשות, והחזקת סם מסוכן (הרואין – 8.8405 גרם נטו) שלא כדין ושלא לצריכה עצמית. ביום 3.9.07 שמע בית המשפט מספר עדים, בנוכחות העותר ובנוכחות באת כוחו מטעם הסנגוריה הציבורית (עו"ד קינן). באותו מועד נקבעה הישיבה הבאה ליום 12.11.07, והעותר הוזהר באשר לחובתו להתיצב, אך הוא לא התיצב, וחרף בקשת באת כוחו (עו"ד קן ציפור, אשר החליפה את עו"ד קינן) נשמעו עדי התביעה הנוספים, ואף נחקרו בחקירה נגדית.

ג. בשלב זה התעוררו קשיים באיתור העותר. לאחר שנמצא, ביקש העותר להפסיק את ייצוגו על ידי הסנגוריה הציבורית, ובקשתו התקבלה ביום 7.2.08. ביום 29.4.08 דחה בית המשפט את בקשת העותר להורות על זימון מחדש של העדים שנשמעו בהיעדרו, מן הטעם שהעותר "היה מיוצג על ידי עו"ד ובחר שלא להתייצב בישיבת ההוכחות". ביום 13.5.08 נדחה בבית המשפט המחוזי מרכז (השופטת לורך) ערר על החלטה זו (ע"ח 366-05-08); ערר זה התייחס גם לכך שלא הועבר לעותר, לטענתו, מלוא חומר החקירה. הערר נדחה משלא קמה לעותר זכות לערור על החלטת ביניים (ובעניין חומר החקירה, נאמר כי עליו לפנות לבית משפט השלום).

ד. בעתירתו טוען העותר כי ביום 12.11.07, בו נשמעו עדי התביעה בהיעדרו, אושפז בבית החולים. עוד טוען העותר שאף כי הוזהר על חובתו להתיצב לדיון בעניינו, לא הוזהר כי ניתן יהיה לדונו שלא בפניו. העותר סבור כי שמיעת העדים שלא בנוכחותו פגעה משמעותית בהגנתו ובזכותו ליומו בבית המשפט, ועלולה להביא לעיוות דין ולאי צדק.

ה. לא נוכל להיעתר לעתירה. החלטת בית משפט השלום לשמוע את עדי התביעה שלא בנוכחות העותר היא החלטת ביניים בהליך הפלילי המתנהל נגדו. כלל הוא כי אין בית המשפט הגבוה לצדק מתערב בהחלטות ביניים בהליך פלילי, אלא במקרים חריגים ויוצאים מן הכלל – כגון משמתגלים העדר סמכות או שרירות לב קיצונית בתחום מינהלי טהור (בג"ץ 5005/06 בדארנה נ' מדינת ישראל (לא פורסם, 21.9.06); בג"ץ 5107/07 בניאורישווילי נ' בית המשפט המחוזי בתל אביב-יפו (לא פורסם, 17.9.07)). אך מעבר לכך אין עומדת לבעל דין האפשרות לערער על החלטת ביניים במסגרת הליך פלילי, לא בזכות ולא ברשות, ואין לעקוף כלל זה באמצעות פנייה לבית המשפט הגבוה לצדק (בג"ץ 5537/91 אפרתי נ' אוסטפלד, פ"ד מו(3) 501, 507–508 (1992); בג"ץ 6371/94 דרעי נ' בית המשפט המחוזי בירושלים, פ"ד מט(1) 133, 135(1995)).

ו. העיון בנספחי העתירה מגלה, כי עניינו של העותר אינו בא בגדר החריגים שבהם תישקל התערבות בהחלטת ביניים בפלילים. כפי שציין בית משפט השלום בישיבת 12.11.07, הוזהר העותר על-ידיו לפני כן באשר לחובת התיצבות, והחלטה לשמוע עדים בהיעדרו היתה לאחר שלא התייצב חרף זאת. בישיבה נוספת ב-19.11.07 לא שמע בית המשפט את העדים נוכח היעדרו של העותר ואי שיתוף פעולה עם הסנגוריה מצדו, אך גם הורה על מעצרו ללא שחרור. לא ברור מה אירע לאחר מכן, אך בישיבת 29.4.08 (לאחר דיון בישיבת 8.4.08) דחה בית המשפט בקשה להורות מחדש על זימון עדים שנשמעו, וכאמור, נדחה נסיון ערעור בבית המשפט המחוזי. לא ראינו כאמור עילה להתערבות בית משפט זה. לעותר שמורה, כמובן, הזכות לערער על החלטת בית משפט השלום במסגרת ערעור על פסק הדין, ככל שיראה בכך צורך. אשר על כן, כאמור, אין מקום להיעתר לעתירה. דין העתירה להידחות על הסף.
