הנשיא א' גרוניס:

1.לפנינו עתירה למתן צו על-תנאי שהוגשה ביום 14.8.2013, ושעניינה קיומן של הבחירות למועצת הרבנות הראשית לישראל (להלן – המועצה) במועד שנקבע לכך לפי חוק הרבנות הראשית לישראל, התש"ם-1980 (להלן – החוק).

2.על פי סעיף 16 לחוק, חבר מועצה נבחר יכהן חמש שנים, והבחירות לחברי המועצה הנבחרים תיערכנה לא יותר משלושה חודשים ולא פחות מחודש אחד לפני תום כהונתם של המכהנים אותה שעה. בהתאם להוראת חוק זו, ובהינתן מועד פקיעת כהונתם של חברי המועצה הנבחרים הנוכחיים, היה על הבחירות למועצה להתקיים עד ליום 11.9.2013. חברי המועצה הנבחרים, להבדיל מחברי המועצה המכהנים מכוח תפקידם, נבחרים על ידי אסיפה בוחרת, בהתאם לסעיף 4(א)(3) לחוק. בין חברי האסיפה הבוחרת נמנים 31 ראשי רשויות מקומיות (לפי סעיף 8 לחוק). לדברי המשיבים, בעקבות סמיכות מועדיהן של הבחירות למועצה ושל הבחירות לרשויות המקומיות (אלה האחרונות נערכו ביום 22.10.2013) עלה חשש שמא ראשי הרשויות המקומיות לא יוכלו להיות שותפים להליך הבחירות של חברי המועצה באופן מלא. משכך, אישרה הממשלה, בהחלטתה מיום 4.8.2013, טיוטת הצעת חוק לפיה תוארך כהונתם של חברי המועצה הנבחרים בשישה חודשים.

3.כאמור, העותרים עמדו בעתירתם על כך שעל המשיבים לפעול לשם קיום הבחירות למועצה במועד, כקבוע בסעיף 16 לחוק. בתגובתם לעתירה, ציינו המשיבים כי מתקיימים הליכי חקיקה בכנסת לגבי הצעת החוק הנזכרת, וכי אישורה יביא לדחיית מועד הבחירות למועצה. לאחר כשבועיים, משלא צלחו מאמצי החקיקה, הודיעו המשיבים כי הם יפעלו בזריזות הראויה לקיום הבחירות למועצה בהקדם. בעקבות זאת, התכנסה ועדת הבחירות למועצת הרבנות הראשית לישראל ביום 15.9.2013 וקיבלה החלטה כי הבחירות למועצה יתקיימו ביום 10.10.2013. הבחירות אכן נערכו במועד זה.

4.משכך, התייתרה העתירה, שהרי זכו העותרים לקבל את הסעד המבוקש, וברי כי דינה להימחק. לטענת העותרים, יש לפסוק לטובתם הוצאות "לדוגמה". זאת, בשל התנהלות המשיבים שהביאה להגשת העתירה מלכתחילה, ובהיות העתירה מוצדקת, שהרי היא הביאה לקידום הטיפול בסוגיית הבחירות למועצה. אומנם, לבית המשפט מסור שיקול דעת בעת קביעת שיעור ההוצאות שיש לשלם (ראו תקנה 20(ב) לתקנות סדר הדין בבית המשפט הגבוה לצדק, התשמ"ד-1984, בצירוף תקנות 511 ו-512 לתקנות סדר הדין האזרחי, התשמ"ד-1984; רענן הר-זהב סדר הדין בבית המשפט הגבוה לצדק 109-108 (1991)), אולם יש לזכור כי פסיקת הוצאות אינה מהווה, בדרך כלל, סעד עונשי (ראו, למשל, בג"ץ 891/05 תנובה מרכז שיתופי לשיווק תוצרת חקלאית בישראל בע"מ נ' הרשות המוסכמת למתן רשיונות יבוא – משרד התעשיה, המסחר והתעסוקה, פיסקה 15 (כבוד הרשם י' מרזל) (30.6.2005)). מכל מקום, בענייננו, דומה כי העתירה אכן הביאה, בין במישרין ובין בעקיפין, לזירוז ההליכים ולקביעת מועד הבחירות למועצת הרבנות הראשית לישראל. בכך עשו העותרים שירות לכלל הציבור, וראוי ששיעור ההוצאות שתיפסקנה ישקף זאת (ראו, ע"א 9535/04 סיעת "ביאליק 10" נ' סיעת "יש עתיד לביאליק", פ"ד ס(1) 391, 396 (השופט א' גרוניס) (2005); ראו גם, למשל, בג"ץ 4500/11 פינקלשטיין נ' הממונה על תשלום הגימלאות/הממונה על השכר, משרד האוצר, פיסקה 4 (30.9.2013)).

5.העתירה נמחקת איפוא. המשיבים ישאו באגרת העתירה וכן בשכר טרחה בסך 12,000 ש"ח.
