השופט ע' פוגלמן:

1.במוקד העתירה שלפנינו, טענת העותרים כי המשיבות 4 – 7 (להלן: חברות התקשורת) אינן רשאיות להקים אנטנות סלולריות מבלי לקבל היתר בניה, תוך שהן מסתמכות על הוראות סעיפים 27א ו-27ב לחוק התקשורת (בזק ושידורים), התשמ"ב – 1982 (להלן: חוק התקשורת), המעניקות פטור מהיתר בניה בעת הקמת "מתקני גישה אלחוטית". העותרים מבקשים סעד שיורה למשיב 2 (שר הפנים) שלא ליתן לחברות התקשורת פטור מהיתר בניה בהסתמך על הוראת סעיפים 27א ו-27ב לחוק התקשורת; כי המשיב 1 (השר להגנת הסביבה) ימנע מליתן היתרי הקמה והפעלה לאנטנות סלולריות שהוקמו ללא היתר בניה, תוך הסתמכות על הוראות סעיפים 27א ו-27ב לחוק התקשורת, ויורה על ביטולם של היתרי ההקמה וההפעלה שניתנו עד כה לאנטנות סלולריות שהוקמו בדרך האמורה. כן מבקשים העותרים סעד שיורה על ביטול קביעתו של המשיב 3 (שר התקשורת) במסגרת תקנות התקשורת (בזק ושידורים) (תדרים למיתקני גישה אלחוטית), התשס"ב – 2002, כי תדרי התקשורת הסלולרית נכללים בתדרים בהם יופעלו "מתקני גישה אלחוטית". נוסף לאלה מתבקש סעד שיורה לשר הפנים לפעול בהתאם להנחיות ועדת מנכ"לים שהוקמה על ידי הממשלה (להלן: ועדת המנכ"לים), ובכלל זה לקיים דיון ציבורי בשאלת הצורך באספקת שידורי וידאו ואינטרנט במסגרת שירותי "הדור השלישי" ו"הדור הרביעי" על גבי הרשת הסלולרית (להלן: הדיון הציבורי). עם העתירה התבקש צו ביניים שיאסור על שר הפנים והשר להגנת הסביבה להעניק לחברות התקשורת "פטורים מקבלת היתרי בניה ו/או היתרי הקמה ו/או היתרי הפעלה, אגב הקמת אנטנות סלולריות, על יסוד החריג של 'מתקני גישה אלחוטית'".

לעמדת המדינה יש לדחות העתירה על הסף נוכח אי מיצוי הליכים. פנייה בכתב למשיבים בעניינים נושא העתירה נערכה רק ביום 9.7.07, כשבועיים לפני הגשת העתירה, כך שלא נותר למשיבים פרק זמן סביר לבחינת הטענות המוצגות בפנייה האמורה. בצד האמור מציינת המדינה, כי נערכת בחינה של הסוגיות המועלות בעתירה על ידי משרד המשפטים, בשיתוף משרדי הממשלה הרלוונטיים.

חברות התקשורת מבקשות אף הן לדחות העתירה והבקשה לצו ביניים. החברות מציגות בתגובות מטעמן טיעונים שונים. בכלל זה הן טוענות כי העתירה נתונה לסמכותו העניינית של בית המשפט לעניינים מינהליים, כי הוגשה בשיהוי ובחוסר תום לב, וכי לגופם של דברים, אין כל פגם בהסתמכות על הוראות סעיפים 27א ו-27ב לחוק התקשורת כמקור חוקי הפוטר מן הצורך בקבלת היתר בניה לצורך הקמת אנטנות סלולריות. הודגש, כי גם אנטנות סלולריות המוקמות מבלי לקבל היתר בניה, מחויבות בקבלת היתר הקמה והיתר הפעלה לפי חוק הקרינה הבלתי מייננת, התשס"ו – 2006. בהתייחס לצו הביניים המבוקש נטען עוד כי הוא חסר נפקות מעשית, שכן הפטור מהיתרי בניה הוא מכוח הדין, ואינו מותנה באישור של מי מן המשיבים 1 – 2.

2.דין העתירה להידחות על הסף מחמת אי מיצוי הליכים, מבלי שנדרש לגופה של העתירה, או לטענות אחרות שהעלו המשיבים.

כעולה מן העתירה, פניה בכתב למשיבים בעניינים נושא העתירה נערכה לראשונה ביום 9.7.07. העתירה הוגשה ביום 25.7.07, כשבועיים לאחר עריכת הפנייה האמורה. בשים לב למורכבות הסוגיות שהוצגו בפנייה האמורה, פרק הזמן שחלף עד להגשת העתירה אינו מאפשר את בחינתן בצורה נאותה, ועל העותרים היה להמתין פרק זמן סביר לקבלת תשובת המשיבים, בטרם יפנו לבית משפט זה (השוו: בג"צ 2624/97 ידיד נ' ממשלת ישראל, פ"ד נא(1) 71, 82 – 83 (1997); בג"צ 6394/04 ארגון האמבולנסים הפרטיים בישראל נ' מגן דוד אדום (לא פורסם, 10.2.05); בג"צ 9403/05 מסוף העברת מסמכי מחשבים בע"מ נ' שר האוצר (לא פורסם, 6.10.05)). העותרים אמנם טוענים כי עוד קודם לכן הם פנו "מספר רב של פעמים אל המשיבים באמצעות שיחות ופגישות", אך טענה כוללנית זו, אשר אינה מפורטת ואינה מגובה בכל מסמך שהוא, אינה יכולה להוות את מיצוי ההליכים הנדרש.

תמונת הדברים דומה גם בהתייחס לסעד הנוגע ליישום מסקנות ועדת המנכ"לים ולעריכת הדיון הציבורי. ככל הנוגע ליישום מסקנות ועדת המנכ"לים לא הוצגה כל פנייה מקדימה שנערכה למשיבים, למעט בנושא הספציפי של עריכת הדיון הציבורי. בהקשר אחרון זה הוצג סיכום פגישה שנערכה ביום 23.10.06 בין נציגי העותרת 1 (ובכללם, העותרים 2 – 3) לבין נציגי המשרד להגנת הסביבה (ובכללם השר להגנת הסביבה), בו נכתב כי "השר מוכן לקיים דיון ציבורי בקשר לדור הרביעי, הפורום ישלח את הצעתו למשתתפי הדיון ללשכת השר". עד כה לא נערך הדיון הציבורי האמור, והסיבה לכך לא התבהרה. מכל מקום, אין מקום לקיים דיון בנושא זה, שלכאורה אינו שנוי במחלוקת, במנותק מהנושאים האחרים שמועלים בעתירה.

סוף דבר – דין העתירה להידחות על הסף וכך אנו מורים.

למותר לציין כי עם השלמת הבחינה הנערכת על ידי משרד המשפטים, בשיתוף משרדי הממשלה האחרים, ומתן תשובה בכתב לפניה, יהיו העותרים רשאים לפנות לבית המשפט המוסמך, אם תהיה עילה לכך.

נוכח התוצאה אליה הגענו, הדיון בבקשת ההצטרפות שהוגשה מטעם אדם טבע ודין – אגודה ישראלית להגנת הסביבה מתייתר; והבקשה נמחקת בזה.
