פסק-דין

1.בעתירה המתוקנת שבפנינו מלינים העותרים על צו החרמה שהוצא על ידי המשיב 1 ביום 3.8.2013 לגבי ציוד שנתפס בפשיטה של כוחות צה"ל על תחנת שידור של העותרים הפועלת בעיר רמאללה. הצו הוצא מאחר ולשיטת המשיבים עושה תחנת השידור שימוש בתדר בלתי מאושר.

2.שמענו טיעונים בשתי ישיבות והוגשו לנו הודעות משלימות על ידי בעלי הדין. נראה לנו כי בנסיבות העניין יש לקבוע כדלקמן:

א. הציוד שנתפס על ידי כוחות צה"ל יוחזק בידי המשיבים.

ב. לעת הזו יעמוד צו ההחרמה על כנו.

ג. היה והעותרים יקבלו היתר כדין לעשות שימוש בתדר חדש ישקלו המשיבים בנפש חפצה החזרה של הציוד שנתפס.

3.נעיר, למען הסר ספק כי בעתירה זו לא נדונה השאלה האם על המשיבים לאשר לעותרים לעשות שימוש בתדר חדש. נוסיף ונציין, כי המשיבים טענו בפנינו שהתחנה ממשיכה לשדר אף כיום באותו תדר שלא אושר. פרקליטם של העותרים אישר שאכן שולחיו ממשיכים לעשות שימוש בתדר הלא מאושר, אך השידור הוא בעוצמה נמוכה מזו בה נעשה שימוש בעבר, לפני תפיסת הציוד על ידי צה"ל.

4.העתירה נמחקת איפוא בכפוף לאמור בפיסקה 2 לעיל.
