ה עותר, עורך דין במקצועו, מלין בעתירה שבפנינו על כך שראש ההוצאה לפועל השית עליו בהחלטתו מיום 1.6.09 הוצאות אישיות בסך 1,000 ש"ח.

דין העתירה להידחות על הסף מחמת קיומו של סעד חלופי ונפנה את העותר להוראת סעיף 80(ב) לחוק ההוצאה לפועל, התשכ"ז-1967 הקובעת כלהלן:

"צווים והחלטות של רשם ההוצאה לפועל, לרבות החלטות בערר לפי סעיף קטן (א), ניתנים לערעור, ברשות רשם ההוצאה לפועל או שופט בית משפט השלום לפני בית משפט השלום; אולם ערעור על החלטה לפי סעיפים 19, 25, 48 ו-58, יהא בזכות".

א שר על כן, העתירה נדחית על הסף.
