לפנינו עתירה כנגד החלטת בית משפט השלום בקרית-גת להורות על נתיחת גופתו של המנוח שלומי אדרי ז"ל, אשר על פי הנתונים שבידי המשטרה מותו נגרם בעבירת אלימות. עיינו בחומר הראשוני של החקירה המצוי בידי המשטרה, ביקשנו הסברים ופרטים ואף קיבלנו חוות דעת של פרופ' היס כי לא ניתן לקבוע את סיבת המוות על פי בדיקה חיצונית בלבד של המנוח.

בית המשפט קמא פסק כי יש לנתח את הגופה במכון הפתולוגי ושעל המומחים יהיה להפסיק כל פעילות הקשורה לגופה, "ברגע שיש בידיהם מספיק נתונים לבסס את ממצאיהם בלי לפגוע בכבוד המת".

מקובלת עלינו החלטתו של בית משפט השלום, לרבות הסייג לצמצום הנתיחה. הבהרנו לבא-כוח העותרים ולעותרים עצמם את הטעמים שבגינם נדרשת הנתיחה. בנסיבות המיוחדות של העניין ובהתחשב במגבלות שניתן להגביל את הנתיחה, נתן בא-כוח העותרים הסכמתו להשארת ההחלטה על כנה, זאת בהתחשב בכך שפרופ' היס ציין בחוות דעתו כי כדי לקבוע את סיבת המוות יש לבצע בדיקה חלקית של בית החזה והבטן בלבד. לפיכך, אנו מורים כי הנתיחה אכן תהיה חלקית ורק במינימום הנדרש לשם קביעת סיבת המוות. המכון הפתולוגי יבצע את הנתיחה עוד היום, על פי המגבלות האמורות.
