1.בפנינו עתירה לביטול החלטת משיב 1 – בית משפט השלום בתל אביב (להלן: 'המשיב') לזימון עד מטעם בית המשפט, במסגרת הליך פלילי שמתנהל נגד העותר.

נגד העותר הוגש כתב אישום בבית משפט השלום בתל אביב (ת"פ 5633/09). לאחר שנסתיימה פרשת התביעה הוא טען שאין להשיב לאשמה. הצדדים הגישו סיכומים בעניין, אולם במקום להכריע בטענה, החליט המשיב לזמן את מומחה התביעה כעד מטעם בית המשפט. כך כתב: "לאור סיכומי הנאשם ותגובת המאשימה לכך, אין מנוס מלהעיד את המומחה החתום על חוות הדעת בתיק, על מנת שבית המשפט יוכל לגבש את החלטתו בתיק". העותר סבור כי החלטה זו מרוקנת מתוכן את טענתו לפיה אין להשיב לאשמה. החלטת בית המשפט בפועל מאפשרת מקצה שיפורים לראיות התביעה, כפי שהוגשו על ידה ואשר אין בהן, על פי הנטען, כדי לעמוד בדרישה המוטלת על התביעה בשלב של אין להשיב לאשמה. החלטת בית המשפט אף מנוגדת, לגישת העותר, לסעיף 167 לחוק סדר הדין הפלילי [נוסח משולב], התשמ"ב-1982, הקובע כי לבית המשפט סמכות להורות על זימון עד מטעמו רק לאחר שבעלי הדין סיימו את הבאת ראיותיהם. לאמור, לא ניתן לזמן עד מטעם בית המשפט רק בתום פרשת התביעה. עוד הודגש שהפסיקה קבעה כי השימוש בסמכות לזמן עדים מטעם בית המשפט בהליך פלילי צריכה להיעשות בזהירות, במקרים יוצאים מן הכלל ובתנאי שלא ייגרם עיוות דין לנאשם. כאן, עולה לכאורה שבית המשפט היה צריך לזכות את הנאשם משלא הוכחה האשמה, ועל כן -להשקפת העותר - זימון העד בשלב זה גרם לו לעיוות דין.

2.ההחלטה עליה מבקשת העותר להשיג הינה החלטת ביניים בהליך פלילי. על החלטה מסוג זה לא קיימת זכות ערעור בטרם סיום ההליך, אלא במקרים: "חריגים ונדירים ביותר, שבהם מועלית טענה ממשית בדבר חוסר סמכות, או מתגלית תופעה קיצונית של שרירות" (בג"ץ 3181/08 רוברט דיוטש נגד מדינת ישראל (8.8.08)). יפים לענייננו הדברים שנאמרו בעניין עיאדה (בג"ץ 876/00 - סעיד עיאדה נ' מדינת ישראל ואח' (29.2.00)): "הכלל הוא, כי בית-משפט זה אינו יושב כערכאת ערעור על החלטות ביניים בהליך פלילי, ובין היתר, על החלטות שניתנו בעקבות טענת "אין להשיב לאשמה" (ראו בג"צ 870/97 אפרים נ' מדינת ישראל (טרם פורסם))". בית משפט זה, בשבתו כבית משפט גבוה לצדק, אינו משמש כערכאת ערעור על החלטות של בית המשפט המחוזי (ראו: בג"ץ 583/87 הלפרין נ' כב' סגן נשיא בית המשפט המחוזי בירושלים, פ"ד מא (4) 683 (1987); בג"ץ 5679/07 קבלר נ' כב' השופט אהרון אמינוף (27.6.2007)).

נימוק נוסף לדחיית העתירה נובע מאי מיצוי, במובן מסוים, אפיקים אחרים העומדים לרשות העותר, טרם פנייה לבית משפט זה. מבלי לתחום גבולות נדמה כי בנסיבות העניין רשאי יהא העותר לפנות לבית משפט השלום תוך העלאת הסתייגויותיו מהזמנת העד. הדבר מתאפשר ולו מן הטעם שכנראה בית משפט השלום לא ביקש את תגובת העותר טרם הורה על הזמנת העד. מסקנה זו נובעת מכך שבית המשפט לא התייחס לכל הסתייגות של העותר בהחלטתו, אשר כנראה טרם נידונה על ידי הערכאה המבררת. קיומו של סעד חלופי כזה אף הוא מהווה בסיס לדחיית העתירה על הסף.

3.לאור האמור דין העתירה להידחות על הסף. משלא נתבקשה תגובה אין צו להוצאות.
