העתירה שלפנינו התמשכה והלכה וכדי שנוכל לקדם את הטיפול בסלילת הכביש המוביל לבית הספר אל אטרש ולמרכז השירותים החיוניים במקום, עקבנו אחר טיפול המשיבים בסלילת הכביש נשוא העתירה וקיבלנו הודעות עידכון מפעם לפעם. לא היה חולק בפנינו על חשיבות סלילת הכביש המבוקש לאחר שלפני כ-3 שנים ארעה במקום תאונה מחרידה בה קיפח ילד את חייו. עקב הצורך בקידום התכניות, בהערכת תקציבים ובהקצאת תקציבים יעודיים, במכרזים למציאת קבלן לביצוע וכן הצורך להתגבר על תביעות לזכויות במקרקעין נוצר פער זמנים בין המאמץ שהשקיעו המשיבים כדי לקדם את התכנית והסלילה לבין הביצוע. בסופה של דרך (תרתי משמע) נתבשרנו היום כי הסלילה בוצעה בעיקרה ונותרו עוד 200 מטר להמשך הסלילה, המעוכבת בשל התנגדותם של תובעי הזכויות במקרקעין. פרשה זו חייבת להסתיים בהקדם ובעונת הקיץ שכן עם תום חופשת הקיץ יש סיכון בהותרת המצב הנוכחי. עם זאת העתירה שלפנינו מוצתה ואנו מניחים כי בהתחשב בשלב המתקדם של ביצוע הסלילה ניתן לסיים את העבודות בקרוב.

על יסוד הנחה זו בשלב הנוכחי של הטיפול בהשגת הסעד המבוקש דין העתירה להידחות לאחר שיעדיה הושגו.

המשיבים 1 ו-2 כאחד ובמשותף ישאו בהוצאות העותרים בעתירה זו בסכום כולל של 10,000 ₪.
