פסק-דין

1.בית המשפט המחוזי בירושלים, בשבתו כבית משפט לעניינים מינהליים, דחה את בקשת המבקש לצו ביניים שיורה למשיבים – עד להכרעה בעתירתו – לחדש את הרישיון לישיבת ביקור מסוג ב/1 שהיה בידו טרם שהחליטו המשיבים שלא להכיר במבקש כפליט, בניגוד להמלצה החיובית של נציבות האו"ם לפליטים.

על החלטה זו הוגשה בקשת רשות הערעור שלפני.

2.המדינה, בתגובתה לבקשה, הודיעה כי החליטה, לפנים משורת הדין, להיעתר לבקשת המבקש וליתן לו רישיון לישיבת ביקור מסוג ב/1, עד להכרעה בעתירה המינהלית שהגיש, מבלי שיהיה בכך כדי לנקוט עמדה לגופה של ההחלטה הנתקפת בעתירה המינהלית.

3.נוכח הסכמת המדינה לכך, החלטתי לדון בבקשת רשות הערעור כאילו ניתנה רשות והוגש ערעור על פיה.

4.בשים לב לאמור בפיסקה 2 שלעיל – דין הערעור להתקבל ולמבקש יינתן רישיון לישיבת ביקור, כאמור שם ועד לתום 30 ימים לאחר מתן פסק הדין בעתירתו המינהלית. בנסיבות העניין – אין צו להוצאות.
