1.החלטנו לדון בבקשה כאילו ניתנה רשות ערעור וזה הוגש על פיה.

2.דעתנו היא כי בנסיבות של המקרה שהובא בפני בית המשפט המחוזי לא היה מקום לדחות "הודעת חדילה" לגבי אגרות שמירה שגבתה המבקשת מן התושבים, כפי שיוסבר מיד. מ דובר בתובענה ייצוגית נגד רשות, שלגביה חל סעיף 9 לחוק תובענות ייצוגיות, תשס"ו-2006. על פי סעיף 9(ב) לחוק, אין לאשר תובענה ייצוגית נגד רשות אם זו הודיעה שתחדל מגבייה ואם הוכח לבית המשפט שהרשות חדלה מגבייה. במקרה זה מ דובר במה שמכונה "הודעת חדילה סטטוטורית", היינו מצב בו חוק חדש נותן ביסוס לגבייה על ידי רשות. משמע, התנאי הראשון שבסעיף 9(א) נתקיים. השאלה הנוספת היא האם נתקיים התנאי השני. דעתנו היא שאף תנאי זה נתקיים. זאת, לאור עדותה של גזברית המבקשת. אכן, בעדותה עלה שלגבי תושב אחד נמשכו הליכי הגבייה לגבי חוב עבר. העובדה שהוכח כי המבקשת לא פעלה כהלכה במקרה אחד לא די היה בה להביא לממצא כי לא הוכח שהמבקשת חדלה מגבייה. מכאן שלא היה מקום לפסול את "הודעת החדילה".

3.עם זאת נראה לנו כי על מנת למנוע תקלות על המבקשת לשלוח הודעה לכל התושבים כי אינם נדרשים לשלם חובות עבר בגין אגרת שמירה, פעולה שראוי היה לעשותה זה מכבר. בנוסף לכך ראוי שתיעשה פנייה מיידית למשרד הפנים על מנת שיינתן אישור למחיקה מן הספרים של חובות עבר של התושבים בשל אגרת שמירה.

4.אשר על כן, הערעור מתקבל, החלטת בית המשפט המחוזי מבוטלת והבקשה לאישור תובענה ייצוגית נדחית. לא ייעשה צו להוצאות.
