פסק-דין

1.פרשה זו נדונה כבר בשתי ערכאות, וכיום לא נותרה אלא שאלה אחת המצריכה עיון, והיא: האם יש לבצע, במסגרת תביעה נזיקית, ניכוי רעיוני של גמלאות, במקום שבו התובע פעל למיצוי זכויותיו במוסד לביטוח לאומי, אך התגמולים שהוא מקבל נמוכים מאלה שהיו משתלמים לו אילו דיווח אמת לגבי שכרו.

המבקשות הן אשתו ובתו של יוסף שלימוב ז"ל, שנהרג בתאונת דרכים ביום 15.3.2002. התאונה הוכרה כתאונת עבודה – המנוח היה נהג משאית עצמאי. הגמלאות המשולמות למבקשות מבוססות על הדיווחים שמסר המנוח, עובר לתאונה, אודות שכרו. אלא שבפסק-הדין נקבע בסיס שכר גבוה יותר מזה שעליו דיווח המנוח עובר לתאונה. בהתאם לכך נקבע כי יש לנכות גמלאות רעיוניות בהתאם לשכר שנקבע בפסק-הדין. על כך משיגות המבקשות לפנינו, ולעניין זה ראינו לנכון ליתן רשות ערעור ולדון בבקשה כאילו הוגש ערעור לפי הרשות שניתנה.

הלוך מחשבתו של בית המשפט המחוזי בסוגיה האמורה היה כדלקמן: כיוון שהמנוח היה עצמאי, והתאונה ארעה ברכבו-שלו, מ דובר ב"רכב מעביד". בהתאם להלכה הפסוקה, בנסיבות כאלה אין המוסד לביטוח לאומי זכאי לשיפוי מהמבטח הנכנס בנעלי המעביד, שכן המעביד – הוא העובד העצמאי – שילם את דמי הביטוח עבור עצמו. במקרה שלפנינו, המבקשות תבעו את חברת הביטוח של המעביד (הוא המנוח, העובד העצמאי), וזו זכאית לכך שינוכו מן הפיצויים הגמלאות שהיו משתלמות על-יסוד העובדות האמיתיות. "כל תוצאה אחרת" – כך בית המשפט –"תעמיס על כתפיו של המבטח את תוצאות מחדלו הבלתי חוקי של המנוח לשלם את דמי הביטוח כמעביד של עצמו, ולכך אין הצדקה". אף כי בסוגיה זו קיבל בית המשפט המחוזי את עמדתו העקרונית של בית משפט השלום, הרי שבמישור החישוב הורה בית המשפט המחוזי כי הגמלאות הרעיוניות יחושבו לפי בסיס השכר שנקבע ביחס ליום התאונה, ובהתעלם מעליית שכר שנצפתה בהמשך חייו של המנוח אלמלא נהרג בתאונה.

2.מצאתי כי יש מקום ליתן רשות ערעור על-פי המבוקש, והחלטתי לדון בבקשה כאילו הוגש ערעור על-פי הרשות שניתנה. דין הערעור להתקבל.

המנוח היה, כאמור, עובד עצמאי, ולפי ההלכה הפסוקה יש לראות בו, לצורך ענייננו, כמי שחובש לראשו שני כובעים: כובע המעביד וכובע העובד (רע"א 686/97 מנורה – חברה לביטוח בע"מ נ' עזבון תמר, פ"ד נג(5) 145 (1999)). התאונה, במקרה זה, היא איפוא תאונה של עובד ב"רכב מעביד". כיוון שכך, סבורה מבטחת הרכב כי היא זכאית לנכות את תגמולי הביטוח הלאומי המשתלמים לנפגע מכוח זכאותו הנובעת מהיותו "נפגע בעבודה". הכלל הוא, שמקום שבו לא מיצה הניזוק – העובד – את זכויותיו במוסד לביטוח לאומי, זכאי המזיק – המעביד – לנכות"באורח רעיוני" את התגמולים שהיו משתלמים לעובד אילו מוצו הזכויות כאמור. על רקע זה טוענות המשיבות כי יש לנכות מן הפיצויים המשתלמים בגין התאונה את הגמלאות "הרעיוניות" המבוססות על ההכנסות האמיתיות של המנוח, ולא את הגמלאות המשולמות בפועל בהתאם להכנסות שעליהן הצהיר המנוח בפני המוסד לביטוח לאומי. בית-משפט השלום ובית-המשפט המחוזי קיבלו עמדה זו והיו חלוקים אך בשאלת דרך חישוב התגמולים הרעיוניים. עמדה זו אין לקבל, שכן אין כלל מקום, במקרה זה, ל"ניכוי רעיוני" חלף ניכוי הגמלאות המשולמות בפועל.

3.המנוח, בכובעו כמעביד, היה מבוטח במסגרת ביטוח נפגעי העבודה של המוסד לביטוח לאומי, ואת דמי הביטוח שילם בשיעור שנקבע על-פי ההכנסות שעליהן הצהיר. במידה והכנסות מדווחות אלה היו נמוכות מן ההכנסות בפועל – נפקות הדבר היא שגם היקף הביטוח היה נמוך מזה שהיה נקבע אילו הוצהר על הכנסות גבוהות יותר. כל אלה מגולמים, כאמור, בפרמיה. כיוון שכך, אין המעביד- המבוטח (והמבטחת בנעליו) רשאי ליהנות מביטוח בהיקף רחב יותר מזה שנרכש בפרמיה ששולמה. מן הצד האחר של המטבע, אין להעניש את המנוח – והפעם בכובעו כניזוק – ואת התלויים בעקבותיו, בניכוי גמלאות החורגות מאלה שנרכשו בפועל. תוצאה זו מומחשת היטב מקום בו העובד לחוד והמעביד לחוד. המעביד אינו זכאי ליהנות מביטוח רחב יותר מזה אשר רכש, ואילו העובד הניזוק אינו צריך להיענש בשל מחדלי מעבידו, בדרך של ניכוי תגמולים שאינו מקבל.

התוצאה היא שהערעור מתקבל. פסק-דינו של בית-משפט השלום יתוקן באופן שניכוי הגמלאות ייעשה בהתחשב בתגמולים המשתלמים בפועל.

המשיבות ישאו בהוצאות הערעור וכן בשכר טירחת עורך-דין בסכום של 20,000 ש"ח.
