בתוקף סמכותי לפי סעיף 164 לפקודת מס הכנסה (להלן – הפקודה), ובאישור ועדת הכספים של הכנסת, אני מצווה לאמור:
1. קביעת תשלומים לבעל שליטה כהכנסה
תשלומים שמשלמת חברה שהיא בשליטתם של לא יותר מחמישה בני אדם כמשמעותה בסעיף 76 לפקודה, לאחד מחבריה שהוא בעל שליטה בה, בין בכסף ובין בשווה כסף, יהיו הכנסה לענין סעיף 164 לפקודה; לענין זה, ”בעל שליטה“ – כמשמעותו בסעיף 32(9) לפקודה.
