פסק דין

הצענו לצדדים מתווה מוסכם לסיום ההתדיינות בערעורים התלויים ועומדים לפנינו, והצדדים קיבלו את המלצתנו.

אנו מחליטים, אפוא, כלהלן:

א. המחלוקת נושא הערעורים תובא להכרעת המועצה הארצית לתכנון ולבניה (להלן: המועצה הארצית). המועצה הארצית תקיים דיון מחודש (De Novo) בתכנית נושא ההליך. בגדר מכלול השיקולים שתשקול המועצה, תיתן המועצה דעתה גם לטענה שלפיה חלקם של המבנים שהרחבתם מוצעת נבנו ללא היתר (למותר לציין כי אין אנו נוקטים עמדה לגופה של טענה זו, לא במישור העובדתי ולא במישור המשפטי). בהתחשב בהשתלשלות התכנונית והמשפטית עד כה, תקיים המועצה הארצית את דיוניה במהירות הראויה.

ב. לאחר סיום הדיון תינתן על ידי המועצה הארצית החלטה מנומקת.

ג. הסכמה זו הינה בבחינת סוף פסוק לכל הטענות הדיוניות שהועלו בהליכים שלפנינו. למותר לציין – בצד האמור – כי טענותיהם של הצדדים באשר לגופה של ההחלטה החדשה שתינתן על ידי המועצה הארצית שמורות להם.

ד. אנו ממליצים למועצה הארצית לשקול קיום דיון נפרד, במנותק מהתכנית נושא ההליך, שיתייחס לסדר קיום דיונים בנושא שאמור להיות מובא בפני ועדות משנה שונות של המועצה.

ה. פסקי הדין נושא הערעורים שלפנינו מבוטלים.

ו. אין צו להוצאות בהליך זה.
