לאחר שיג ושיח רשמנו לפנינו הצהרת המשיבות 4-3 ולפיה עומק החפירה מתחת לפני הקרקע לא יעלה על 20 מטר, והכל כמובן בגבולות המסומנים לצורכי החפירה בתוכנית, ובמסגרת 5 קומות.

לאחר ליבון שאר הנושאים הודיעו העותרים בהמלצת בית המשפט כי אין להם טענות נוספות ובהצהרה האמורה בא הערעור על סיומו. כל צד יישא בהוצאותיו.
