שני ערעורים מאוחדים על פסק דינו של בית המשפט המחוזי בחיפה מיום 9.5.2010 (כבוד הנשיאה בלהה גילאור) בת"א 625/06.

1.ענייננו בתביעה לפי חוק הפיצויים לנפגעי תאונות דרכים, התשל"ה-1975. המערער בע"א 3662/10 (להלן: המערער), יליד 2.3.1981, נפגע בתאונת דרכים ביום 25.12.2005. המערער אושפז לתקופה של 16 חודשים, כולל תקופת אישפוז בבית החולים לוינשטיין, ו בית המשפט מינה מספר מומחים רפואיים שקבעו את נכותו הרפואית כלהלן: בתחום האורטופדי - 63.7% (משוקלל), בתחום הנוירולוגי - 30% (20% בחופף לאורטופדי), בתחום הנפשי 20% (10% חופף לנוירולוגי), ובתחום הפלסטי 40% בגין צלקות בצוואר, בחזה ובעכוז. סה"כ הועמדה נכותו הרפואית המשוקללת של המערער על 83%.

נספר, כי המערער הוא בוגר מגמת נגרות ללא בגרות, אינו יודע קרוא וכתוב, ועבד מגיל 14 בתחום הנגרות.

2.בית משפט קמא בחן את שכרו של המערער עובר לתאונה ומצא כי שכרו הממוצע עמד על כ-4,000 ₪. לצורך חישוב הפסד ההשתכרות בעבר ובעתיד העמיד בית המשפט את בסיס השכר על 4,500 ₪ לפי נכות תפקודית של 100%, דהיינו, על פי אובדן שכר מלא. בנוסף, פסק בית המשפט למערער בגין הפסדי פנסיה סך של 45,000 ₪; בגין עזרת הזולת לעבר ולעתיד סך של 450,000 ₪; בגין ניידות סך של 150,000 ₪ (תוך התחשבות בתשלומים שעשוי המערער לקבל מהמוסד לביטוח לאומי); בגין התאמת דיור סך של 70,000 ₪ ובגין הוצאות רפואיות סך של 30,000 ₪. הפיצוי הכולל שנפסק למערער הועמד על 2,395,343 ₪ ומסכום זה ניכה בית המשפט תגמולי מל"ל בסך 836,222 ₪.

על פסק דינו של בית משפט קמא נסבים שני הערעורים שבפנינו.

3.אפתח בערעור המבטחות (ע"א 4674/10) ואומר כי לא מצאתי בו ממש וטוב היה משלא היה מוגש מלכתחילה. המשיבות תקפו כמעט כל פריט ופריט בפסק הדין, וכידוע, אין דרכה של ערכאת ערעור לחזור ולבחון לעומק כל ראש נזק, והבחינה היא כללית, אם סכומי הפיצויים שנפסקו הם בלתי סבירים או שנפלה טעות בולטת בהערכת הנזק (ראו, לדוגמה, ע"א 9721/07 איסכור שירותי גילוון בע"מ נ' גוזלן (לא פורסם, 12.9.2010) פסקה 9 והאסמכתאות שם).

אומר בקצרה כי בהתחשב בנכותו הרפואית של המערער, בהשכלתו הדלה, בכך שעבד בעבר בעבודה פיזית וכיום הוא נעזר בקביים, ובהתחשב בחוות דעתו ועדותו של המומחה בתחום הפלסטי לפיה קיים חשש כי ישיבה ממושכת עלולה לגרום להרעה במצב הפצע והצלקת בעכוז, אין מקום להתערב בקביעתו של בית משפט קמא שהעמיד את הפסד השתכרותו של המערער על 100%.

4.המערער הלין על כך ש בית משפט קמא העמיד את בסיס השכר על 4,500 ₪ ועל מיעוט הסכום שנפסק בגין עזרת הזולת ובגין הוצאות רפואיות, בהתחשב בכך שיתכן כי המערער יעבור בעתיד ניתוח פלסטי מסובך בעכוזו.

לא מצאתי להתערב בפסק דינו של בית משפט קמא בנושאים אלה. המערער עובד בנגרות מגיל 14 ולמרות שהיה בן 24 בעת התאונה, כבר הספיק לשרטט ולהתוות את כושר השתכרותו. גם אם ניתן היה להעריך את כושר השתכרותו בעתיד הרחוק בסכום גבוה יותר, איני רואה עילה להתערב בשיקול דעתה של הערכאה הדיונית ששמעה את המערער ואת העדויות והראיות שהונחו בפניה. כך גם לגבי הסכום הגלובלי שנפסק עבור עזרת צד ג', סכום המשקף כ-1,200 ₪ לחודש. המערער משתמש אומנם בקביים אך נקבע כי הוא מסוגל לתפקד באופן עצמאי ונזקק לעזרה מוגבלת בלבד בפעולות מסוימות. אף איני רואה להתערב בסכום שנפסק בגין הוצאות רפואיות, באשר לא הוכח כי ניתוח פלסטי שיעבור המערער בעתיד, אם בכלל, אינו כלול בסל הבריאות.

4.בנקודה אחת מצאתי ממש בערעור. בסיפא לפסק דינו ניכה בית המשפט מסכום הפיצוי הכולל תגמולי מל"ל בסך של כ-836,000 ₪, למרות שטרם נקבעה למערער דרגת אי כושר צמיתה. זאת בהנחה – המבוססת גם על הנכויות הזמניות שנקבעו למערער עד היום – כי למערער תיקבע בעתיד דרגת אי כושר שתזכה אותו בקיצבה מלאה (75%). המערער הביע חשש כי אם המל"ל לא יעמיד את נכותו הצמיתה על 75% הוא יימצא מקופח, ולכן ביקש להקפיא את ניכויי המל"ל, ולמצער, להקפיא חלק מהסכום עד לקביעת נכותו הצמיתה. המשיבות התנגדו לכך בטענה כי יש להביא את ההתדיינות לקיצה.

5.במצב הדברים הרגיל, הנתבעות הן שעותרות להקפאת סכומים מתוך הפיצוי הכולל למקרה שתיקבע נכות במל"ל, ודומה כי בתיק זה התהפכו היוצרות. מכל מקום, אני מקבל את טענת המערער כי אין להעמידו בסיכון - גם אם הסיכון לא נחזה כגבוה - כי הנכות הצמיתה שתיקבע לו בעתיד במל"ל, לא תזכה אותו בקיצבה מלאה.

אשר על כן, אמליץ לחברי לקבל את הערעור במובן זה, שבמקום הניכוי של 836,222 ₪ כפי שנקבע בפסק הדין, ינוכה הסך של 436,222 ₪ בלבד, וסכום של 400,000 ₪ יוקפא לתקופה של 24 חודשים מהיום.

האמור לעיל כפוף לכך שהמערער יפעל בשקידה ראויה מול המל"ל, ומבלי לגרוע מכלליות האמור, יפנה תוך 30 ימים למל"ל בבקשה לקביעת נכות צמיתה, בצירוף חוות הדעת של המומחים שניתנו בתיק זה.

היה ותיקבע למערער נכות צמיתה ובשל כך תגמולי המל"ל שייקבעו יעלו על הסך של 836,222 ₪ (מצב אפשרי בהתחשב בכך שביני לביני התובע נישא, ואם יוולדו לו ילדים הקיצבה תהא גבוהה מזו שעל בסיסה נערכה חוות הדעת האקטוארית בתיק), אזי הסכום לניכוי מהפיצוי יהא גבוה יותר, בהתאם לגימלה שתיקבע למערער. היה ולא תיקבע נכות צמיתה למערער תוך 24 חודשים מהיום, אזי ינוכה מלוא הסכום כאמור בפסק דינו של בית משפט קמא.

6.בכפוף לאמור לעיל, יידחו שני הערעורים. מאחר שערעור המערער התקבל בחלקו, המשיבות ישאו בשכר טרחת המערער בסך 20,000 ₪ בצירוף מע"מ.
