בעקבות חילופי דברים הושגה למעשה הסכמה שהמחלוקת בין בעלי הדין תתברר בגדר המרצת הפתיחה התלויה בפני בית המשפט המחוזי מרכז-לוד.

בא כוחה של המערערת ביקש שיינתן צו מניעה לגבי הדירה שהמערערת טוענת לזכויות בה. בקשה כאמור יש להגיש לבית המשפט המחוזי בגדרו של ההליך התלוי בפניו. אין צורך באישור נוסף מצד בית המשפט שעל הפירוק. כמובן, שאיננו מביעים כל עמדה בשאלה האם יש להיעתר לבקשה כזו, אם וכאשר תוגש. העניין נתון לשיקול דעתו המלא של בית המשפט המחוזי.

הערעור נמחק איפוא בכפוף לאמור לעיל. לא ייעשה צו להוצאות.
