1.על רקע המצב הביטחוני בדרום הארץ, קיבלו ממשלות ישראל במרוצת השנים שורה של החלטות בנושא חיזוק החוסן האזרחי בשדרות וביישובי עוטף רצועת עזה. בהתאם להחלטות אלו ניתנו הטבות שונות ליישובי עוטף עזה, לרבות הנחות בארנונה. הממשלה החליטה כי יישובי עוטף רצועת עזה הזכאים להטבות הם אלה שבתיהם שוכנים במרחק של עד 7 ק"מ מגדר המערכת המקיפה את רצועת עזה (החלטות ממשלה 2173 מיום 4.7.2004 ו-2341 מיום 1.8.2004 וכן החלטות מאוחרות להן, ונעיר כי מקובלת עלינו עמדת הממשלה שלפיה מדובר בבתי המגורים של היישובים). עניינה של העתירה שלפנינו בבקשת העותרות, חברות הפועלות באזור התעשיה הדרומי של העיר אשקלון (להלן: אזור התעשיה), לכלול את אזור התעשיה בגדר "יישובים סובבי עזה" המנויים בתוספת השלישית (להלן: התוספת) לתקנות הסדרים במשק המדינה (הנחה בארנונה), התשנ"ג-1993 (להלן: תקנות ההנחה) ונהנים מהנחות בארנונה כמפורט בתקנה 3ג לתקנות אלו. אזור התעשיה נמצא בחלקו בטווח של עד 7 ק"מ מגדר המערכת ולכן, לטענת העותרות, יש להתייחס אליו כאל יישוב הנמצא בתחום עוטף עזה ולכלול אותו בתוספת.

2.כאשר הוגשה העתירה, בשנת 2010, נכללו בתוספת יישובים שבתי המגורים שבהם מרוחקים מעל 7 ק"מ מגדר המערכת, ומנגד לא נכללו בה יישובים שנמצאים במרחק קטן מ- 7 ק"מ כאמור. העותרות טענו, בין היתר, להפליה ביחס ליישובים שנכללו בתוספת. ביום 13.3.2012 ניתן צו על תנאי שאחד משני ראשיו הורה למשיבים לנמק מדוע לא יכללו בתוספת את כלל היישובים המצויים במרחק של עד 7 ק"מ מגדר המערכת כאמור בהחלטת ממשלה 2341. לאחר שניתן הצו תוקנה התוספת, וכיום היא מונה את כל היישובים שבתיהם מצויים במרחק של עד 7 ק"מ מגדר המערכת ואינה כוללת יישובים שאינם בטווח זה. העיר אשקלון אינה באה בגדר "יישובים סובבי עזה" (כהגדרתם בתקנה 3ג(ג) לתקנות ההנחה) משום שבתיה אינם מצויים בטווח האמור, ולכן אינה נכללת בתוספת. העותרות טוענות כי החלטת הממשלה שלא לכלול את אזור התעשיה בתוספת מפלה אותן ביחס לאזורי תעשיה אחרים שנכללים בה.

3.לאחר שהאזנו לטענות הצדדים ושקלנו אותן, באנו למסקנה כי לא קמה עילה להתערבותנו בהחלטה שלא לכלול את אזור התעשיה בתוספת השלישית לתקנות ההנחה. הקריטריון המנחה שקבעה הממשלה ליישובים הנכללים בתוספת – מרחק של עד 7 ק"מ בין בתי היישובים לבין גדר המערכת – נשען על הערכה מקצועית של מערכת הביטחון שלפיה בטווח זה מופרת שגרת החיים באופן עקבי ואינטנסיבי. ההחלטה שלא לכלול את אזור התעשיה בין יישובי התוספת מתיישבת הן עם לשון החלטת הממשלה – המדברת במרחק בין בתי היישוב לבין הגדר (ואין חולק כי הבתים של העיר אשקלון אינם נמצאים במרחק האמור); הן עם תכליתה – לחזק את החוסן האזרחי של תושבי היישובים הנמצאים בקו העימות הקדמי של מדינת ישראל, על סמך הכרה בכך שטווח זה סובל מהפרעה מתמשכת וקבועה לשגרת החיים האזרחית, ובעל מאפיינים המצדיקים ומיקוד המאמץ הממשלתי במטרה לשמר ולחזק את חוסנם של התושבים. השאלה אלו יישובים ייכללו בתוספת נבחנת מדי שנה ונסמכת על הערכה מקצועית של מערכת הביטחון (ראו, למשל, החלטות ממשלה 4059 מיום 1.1.2012 ו-5207 מיום 4.11.2012). הקריטריון שנבחר מתבסס אפוא על שיקולים הנוגעים לעצמת ותכיפות האיום על אזורים שונים בישראל, וכן על תיחום האזור בהתחשב במגבלות תקציביות ובצורך להבטיח את האפקטיביות של ההטבות. קריטריון זה אף יושם על ידי המשיבים באופן עקבי. כך, הוא הוביל להכללה בתוספת של היישובים תקומה, חוות השקמים ושלומית, הממוקמים כולם במרחק שנע בין 6 ל- 7 ק"מ מגדר המערכת; ולדחיית בקשת היישובים בני נצרים ונווה להיכלל בתוספת משנמצא שבתיהם רחוקים למעלה מ- 7 ק"מ מהגדר. המדובר אפוא בקריטריון סביר, המיושם באופן עקבי ושוויוני, ואין עילה להתערב בו.

4.אין בידינו לקבל את טענת העותרות שלפיה אזור התעשיה דנן מופלה ביחס לאזורי תעשיה אחרים שנכללים בתוספת. אכן, התוספת כוללת את אזור התעשיה ספירים, אזור התעשיה מפעלי שער הנגב ואזור התעשיה ניר עם שער הנגב. ברם, החלטות מספר שקיבלה הממשלה בנושא תכניות החוסן לחיזוק יישובי עוטף רצועת עזה במשך השנים, החל מהחלטה 2173 ואילך, הבהירו כי הגדרת תחום עוטף עזה תכלול, בנוסף לשדרות וליישובי המועצות האזוריות הרלוונטיות שבתיהם שוכנים בתחום של 7 ק"מ משטח הגדר, גם את "אזור שדרות רבתי", הכולל שורה של שטחים בתחום המועצה האזורית שער הנגב הצמודים לעיר שדרות ומהווים חלק בלתי נפרד מן המרקם הפונקציונלי שלה. שטחים אלה משרתים ומחזקים את היישובים והתושבים המתגוררים באזור עוטף עזה ונמצאים במלואם – כמו גם העיר שדרות – בטווח של 7 ק"מ מגדר המערכת. לעומת זאת, בתי המגורים של העיר אשקלון מצויים במלואם מחוץ לטווח זה. אזור התעשיה דנן שוכן בתחומה של העיר אשקלון ורק קצהו נכלל בטווח של 7 ק"מ מהגדר. לכך יש להוסיף כי תשלומי הארנונה בגין אזורי התעשיה הכלולים ב"אזור שדרות רבתי" משולמים לעיריית שדרות או למועצה האזורית שער הנגב – רשויות שנזכרות במפורש בהחלטות הממשלה בעניין עוטף רצועת עזה, שכן יש בשטחן בתים בטווח של 7 ק"מ מהגדר. ההנחה בארנונה לאזורי תעשיה אלה – הממומנת בידי משרד הפנים ומגדילה את האטרקטיביות שלהם – מחזקת את הרשויות הרלוונטיות ואת תושביהן, באופן שעולה בקנה אחד עם החלטות הממשלה ומדיניותה בנושא. שונה המצב בכל הנוגע לתשלומי הארנונה בהתייחס לעסקיהן של העותרות באזור התעשיה הדרומי של אשקלון. אלה משולמים לעיר אשקלון שאינה נמנית עם הרשויות הנכללות בהגדרה של עוטף רצועת עזה, שכן אין בתחומה בתי מגורים בטווח הרלוונטי. הטבות הארנונה, לו היו ניתנות לאזור התעשיה הדרומי של העיר, לא היה בהן כדי לשרת את התושבים הגרים בתחום עוטף עזה. לבסוף, לא למותר לעמוד על מאפייני העיר אשקלון השונים בתכלית ממאפייני יישובי עוטף עזה שנכללים בתוספת. די לציין כי אשקלון מונה כ-117,000 תושבים ואילו אזור עוטף רצועת עזה כולו מונה כ-41,000 תושבים. בשים לב להבדל זה, בהצטבר להבחנה האחרת שעליה עמדנו, החלטת הממשלה למקד מאמץ לטובת האוכלוסייה המצומצמת היושבת בקו החזית ממש, וליתן סיוע לעיר אשקלון במישורים אחרים, אינה חורגת ממתחם הסבירות.

5.סיכומו של דבר, ההבדלים שמנינו לעיל בין איזור התעשיה הדרומי של העיר אשקלון לבין יישובי עוטף עזה ואזורי התעשיה שנכללים בתוספת השלישית לתקנות ההנחה עולים כדי שוני רלוונטי המצדיק להבחין ביניהם לעניין מתן הטבות בארנונה. אשר על כן, החלטנו לקבל את ההתנגדות, לבטל את הצו על תנאי ולדחות את העתירה. בנסיבות העניין, לא ראינו לעשות צו להוצאות.
