פסק-דין

לאחר שמיעת טיעונים הבהרנו לפרקליטים של העותרים כי העתירה לא מגלה שנפגעה זכות חוקתית, משהכנסת קיבלה חוק שהביא להפחתה של קצבאות הילדים. העותרים לא השכילו להראות שמשפחות מסוימות נפגעו בעקבות הפחתת הקצבאות. יש לזכור שלעניין זה של פגיעה חובה להתחשב בתיקוני חקיקה והחלטות מינהליות שהביאו לשיפור במצבן של משפחות, לדוגמה מס הכנסה שלילי, חינוך חינם לגילאי 4-3, טיפולי שיניים לילדים עד גיל 12 ועוד. במלים אחרות, העותרים לא הראו שבחישוב כולל של הנטו, היינו לאחר שמתחשבים הן בקיצוץ והן בתוספות, פחת הסכום שהגיע למשפחות נצרכות. בהמשך לכך יש להראות שהירידה בסכומים, אם אכן הייתה כזו, פגעה בזכות חוקתית.

בעקבות הערותינו הודיע פרקליט העותרים שאינו עומד על העתירה. לפיכך אנו מורים על דחייתה בלא שייעשה צו להוצאות.
