1.המערערים הגישו לבית משפט זה ערעור על פסק דינו של בית המשפט המחוזי בירושלים (ע"מ 29228-12-10, השופט ד' מינץ) מיום 1.11.2012. בפסק הדין נדחה ערעורם של המערערים על השומה שהוציא המשיב לעסקם בעבור השנים 2007-2005. בערעורם התייחסו המערערים לקביעות שונות של בית המשפט המחוזי, אך גם להסכמות שהתגבשו בינם לבין המשיב לאחר מועד פסק הדין באשר לשומה בשנים 2010-2008. ביום 14.11.2013 הגישו המערערים בקשה להוספת ראיות לערעורם ובקשה לדחיית הגשת הסיכומים עד לדיון בבקשה להוספת הראיות. לאחר שהמשיב הביע התנגדותו לקבלת הבקשה להוספת ראיה, קבעה הרשמת בנמלך ביום 31.12.2013 כי הבקשה להוספת ראיות תידון על ידי ההרכב, ודחתה את הבקשה לדחות את הגשת הסיכומים, כיוון שממילא לא יוכלו המשיבים להתייחס לראיות שביקשו להוסיף במסגרתם.

2.על אף החלטות אלה, בסיכומים שהגישו המערערים לבית המשפט הייתה התייחסות נרחבת להסכמות שהתגבשו בינם לבין המשיב באשר לשנים 2010-2008 וגם לראיות החדשות אותן ביקשו להוסיף. למעשה, הסיכומים נסבו ברובם סביב רצון המערערים להחזיר את השומה בגין השנים 2007-2005 למשיב, כדי שיכריע בה על פי העקרונות שגובשו לשנים המאוחרות יותר. בשל כך, ביקש המשיב למחוק את הסיכומים. המערערים התנגדו לבקשה וטענו שלא הזכירו בסיכומים את הראיות החדשות אותן ביקשו להוסיף, ואין מקום להורות על מחיקתם.

3.בהחלטה נושא ערעור זה קיבלה הרשמת את בקשת המחיקה, כיוון שיש בסיכומים הפניה לראיות החדשות שהמערערים ביקשו להוסיף. הרשמת קבעה כי טענת המערערים לפיה הטענות המועלות בסיכומים זהות לנימוקי הערעור, אינה מועילה להם אלא מלמדת על פגם בנימוקי הערעור, וכי טענתם בדבר השתהות המשיב לבקש את מחיקת הסיכומים, לא יכולה להצדיק העלאת טענות בניגוד לדין. עוד ציינה הרשמת כי לא ניתן לאפשר תיאור אירועים שקרו לאחר מתן פסק הדין בערכאה הדיונית, והבהירה כיצד ניתן להתייחס לראיות החדשות במסגרת הסיכומים.

4.מכאן הערעור שלפניי, במסגרתו טוענים המערערים כי לא הפנו בסיכומיהם לראיות הנוספות והם מבקשים למנוע את מחיקתם. עוד טוענים כי הרשמת חרגה מסמכותה וקבעה את היקפם ותוכנם של הסיכומים.

5.כידוע, שיקול דעתה של הרשמת רחב, ולא בנקל תתערב בו ערכאת הערעור (בשג"ץ 8760/12 ואן קול נ' גנות (5.5.2013); בש"א 5814/12 ליברוב נ' בית חולים אלישע (14.8.2012)). המערערים התבססו בסיכומיהם על ראיות חדשות שטרם הוכרעה שאלת צירופן לערעור, זאת בניגוד לסעיף 7(ב)(3) להנחיות הנשיאה מיום 1.11.2010, הקובע כי:

"כל עוד לא הוחלט להתיר את הגשת הראיה, לא תהיה בסיכומים בכתב התייחסות לראיה שהגשתה נתבקשה ולא ניתן יהיה לצרפה לתיק המוצגים" (וראו גם תקנה 457(א) לתקנות סדר הדין האזרחי, התשמ"ד-1984).

די בכך כדי להורות על מחיקת כל הפסקאות המפנות לראיות החדשות, ומעיון בסיכומים עולה שמדובר בחלקם הארי, ולכן לא מצאתי שנפלה כל שגגה בהחלטת הרשמת. מעבר לצורך, יאמר שגם המערערים הבינו עוד מראש את השגגה במעשיהם, כיוון שתחילה ביקשו לדחות את הגשת הסיכומים עד להכרעה בבקשה לצירוף הראיות. ועל אף שבקשתם נדחתה, ובהחלטה של הרשם ג' שני מיום 8.12.2013 הובהר שאין מקום להתייחסות לראיות החדשות במסגרת הסיכומים בכתב, טרם תינתן החלטה בדבר צירופן, עשו המערערים דין לעצמם.

6.עוד אציין כי לא מצאתי שבהבהרתה כיצד יבואו לידי ביטוי הראיות הנוספות, קבעה הרשמת את מלוא תוכן הסיכומים. נימוקי הערעור אינם זהים לסיכומים, והם כוללים גם טענות באשר לתוכן פסק הדין ולקביעות בו. אלא שבסיכומיהם זנחו המערערים טענות אלה והתמקדו אך ורק בהסכמות המאוחרות, שלא היו בפני בית המשפט המחוזי. יש ביד המערערים לטעון נגד הקביעות בפסק הדין. אין בכוחם לטעון טענות ערעוריות הנוגעות להסכמות שהושגו לאחר מתן פסק הדין.

7.סוף דבר, הערעור נדחה. משלא נתבקשה תגובת המשיב, אין צו להוצאות. לנוכח החלטת הרשמת מיום 10.4.2014, לפיה מועדי הגשת הסיכומים מוארכים עד ההכרעה בערעור זה, התיק יוחזר לרשמת ללא דיחוי לשם קביעת מועדים חדשים להגשת הסיכומים על ידי הצדדים.
