השופטת א' חיות:

1.ביום 2.7.2008 הרשיע בית המשפט המחוזי בחיפה את העותר בעבירות של מתן שוחד, מרמה והתחמקות ממס וביום 31.8.2008 גזר עליו בגין עבירות אלה עונש של ארבע שנות מאסר לריצוי בפועל, 12 חודשי מאסר על תנאי, קנס כספי בסך שני מליון ש"ח (או 24 חודשי מאסר תמורתם), וכן הורה על חילוט סך של 3 מליון ש"ח מתוך רכושו. תחילת ריצוי עונש המאסר עוכב על ידי בית המשפט המחוזי עד ליום 14.9.2008 ומועד תשלום הקנסות נקבע ליום 1.11.2008. העותר ערער על הרשעתו ולחלופין על חומרת העונש. הערעור הוגש על ידו לבית משפט זה בשבתו כבית משפט לערעורים, ביום 4.9.2008 (ע"פ 7593/08) ועימו הגיש העותר בקשה לעיכוב ביצועו של גזר הדין עד להכרעה בערעור. בהחלטה מיום 7.9.2008, שניתנה על פי צד אחד, עיכב בית המשפט (כבוד השופט ח' מלצר) את ביצוע גזר הדין עד להכרעה בבקשה, וזו נדונה בפניו במעמד שני הצדדים ביום 21.9.2008, יחד עם בקשה לעיכוב ביצוע גזר הדין שהגיש אשר כהן (המשיב הפורמאלי 2), שהורשע אף הוא באותה פרשה. ההחלטה בשתי הבקשות לעיכוב ביצוע ניתנה ביום 8.2.2009, כארבעה חודשים ומחצה לאחר הדיון במעמד שני הצדדים שהתקיים בהן כאמור, ובה דחה בית המשפט את בקשת העותר בכל הנוגע לעיכוב ביצועו של עונש המאסר בפועל ולתשלום הקנס, אך קיבל את הבקשה לעיכוב ביצוע החילוט, בכפוף לתנאים ולמגבלות שקבע (להלן: ההחלטה). החלטה דומה ניתנה גם בעניינו של כהן, המשיב הפורמאלי

2.העתירה שבכאן מופנית נגד השופט חנן מלצר ומתבקש בה צו על תנאי המורה לו לבוא וליתן טעם מדוע לא תבוטל ההחלטה, בשל הינתנה בחלוף כחמישה חודשים מיום הגשת הבקשה. העותר מדגיש כי עתירתו עוסקת "במימד הזמן" ואין לראותה כערעור על ההחלטה שאת ביטולה הוא מבקש, בהדגישו כי החלטות בבקשות כגון אלה ראוי להן כי תתקבלנה בזריזות ולכל היותר בתוך שבועות ספורים, וכי חלוף הזמן יורד לשורש הלגיטימיות של ההחלטה ויש בו כדי לפגוע באמון העותר במערכת המשפט ולהותירו עם התחושה כי עניינו לא נדון כנדרש. לחלופין מבקש העותר לראות בעתירתו משום בקשה לעיון חוזר בהחלטה והוא מוסיף ומבקש כי יינתן צו ביניים המעכב את ביצוע עונש המאסר, עד להכרעה בעתירה.

3.דין העתירה להידחות על הסף.

הכלל הקבוע בסעיף 15(ד)(3) לחוק-יסוד: השפיטה הוא כי בית המשפט הגבוה לצדק לא יידרש לעתירות המופנות כנגד בתי המשפט שחוק היסוד דן בהם ובכללם בית המשפט העליון בשבתו (בין היתר) כבית משפט לערעורים פליליים. אכן, יתכנו מקרים חריגים ונדירים בהם יידרש סעד למען הצדק על פי סעיף 15(ג) לחוק יסוד: השפיטה, המופנה כנגד בית משפט כאמור, למשל בשל חריגה מסמכות או פגיעה בולטת בעיקרי הצדק הטבעי (ראו בג"ץ 1530/08 עוה"ד אורי גנור נ' בית משפט העליון (לא פורסם, 25.2.2008); בג"ץ 8117/05 אזולאי נ' בית משפט העליון בירושלים (כב' השופטת נאור) (לא פורסם, 28.9.2005)), אך נראה כי המקרה שבפנינו אינו נמנה עם מקרים נדירים וחריגים אלה.

אין חולק כי בית המשפט מחוייב לעשות כל מאמץ לדון בבקשה לעיכוב ביצוע גזר דין במהירות הראויה הן בשל האינטרס הציבורי הקיים בביצוע מיידי של גזרי דין והן בשל האינטרס שיש לנאשם כפרט לדעת האם ומתי עליו להתחיל בריצוי עונשו. אך מטבעם של דברים אין עניין אחד דומה למשנהו ו"המהירות הראויה" משתנה אף היא ממקרה למקרה ותלויה בנסיבות. במקרה דנן מדובר בבקשה לעיכוב ביצוע גזר דין שנלוותה לערעור רחב היקף, בו מלין העותר על הרשעתו בפרשה מורכבת ועתירת עדויות ומוצגים. הבקשה וכמוה גם בקשתו של המשיב הפורמאלי 2 שנדונה יחד עימה, הצריכו בדיקה ועיון יסודי בטענות הרבות שהועלו בה על ידי העותר ועל ידי המשיב הפורמאלי 2, לעניין סיכויי הערעור. ציפייתו הדרוכה של העותר למתן ההחלטה נשוא העתירה מובנת וברורה, יחד עם זאת יש לזכור כי במהלך כל התקופה שבה המתין להחלטה היה העותר משוחרר בתנאים מגבילים, על פי החלטת הביניים שניתנה בעניינו ביום 7.9.2009. בהינתן עובדה זו ובהינתן יתר הנסיבות המפורטות לעיל, איננו סבורים כי המקרה דנן נמנה עם אותם מקרים נדירים וחריגים המצדיקים ביטולה של החלטה שיפוטית "למען הצדק" על פי סעיף 15(ג) לחוק יסוד: השפיטה.

אשר על כן, העתירה נדחית.
