העותרים מבקשים להורות למשיב ליתן טעם מדוע לא תבוטל תקנה 472 לתקנות סדר הדין האזרחי, התשמ"ד-1984 (להלן: התקנות).

1.מהעתירה על נספחיה, עולה כי העותר מס' 2 שהוא אסיר בכלא צלמון בגליל, "מיוצג" על ידי חברו העותר מס' 1, בתביעה כספית ע"ס 129,500 ₪ שהגיש בבית משפט השלום בתל-אביב (ת.א. 53038-02-12) כנגד שירות בתי הסוהר וכנגד מפקד כלא צלמון בגין "עוגמת נפש, פגיעה קשה ברגשות ובגין מסכת ההשפלות, האיומים, ההפחדות וההתעמרויות" שהעותר 2 חווה לטענתו בבית הכלא (התביעה נגד מפקד הכלא נדחתה בהמשך, לאחר שהמדינה הודיעה על הכרה בחסינות בהתאם להוראות סעיף 7א לפקודת הנזיקין [נוסח חדש]).

2.העותר מס' 1 אינו עורך דין. באת כוח המדינה, המייצגת את שירות בתי הסוהר בתביעה המתנהלת בבית משפט השלום, טענה כי העותר 1 מגיש הליכים רבים כנגד המדינה, וכי נוכח כמות ההליכים, יש ספק אם הוא אכן ידיד קרוב של העותר 2. נטען, כי הכרה בו כמייצג מאיינת את סעיף 20 לחוק לשכת עורכי הדין, התשכ"א-1961, שעניינו ייחוד פעולות המקצוע ואת תקנה 472 לתקנות הקובעת כלהלן:

"כל פעולה בבית משפט הנדרשת מאת בעל דין או המותרת לו על פי דין, רשאי בעל דין לעשותה בין בעצמו ובין על ידי עורך דין שהודיע בכתב הטענות הראשון שהוא מגיש, שיש בידיו ובידי עורכי הדין הכלולים ברשימה כאמור בתקנה 472א ייפוי כוח מטעם בעל הדין, והוא כשאין הוראה מפורשת אחרת בכל דין; אין בהוראת תקנה זו כדי למנוע מבית המשפט לחייב, ביזמתו או לפי בקשה, את המצאת ייפוי הכוח לכל בעל דין או לבית המשפט" (הדגשה הוספה – י"ע).

בהחלטה קצרה שניתנה על אתר, דחה בית המשפט את טענת המדינה, והתיר לעותר 2 לסייע לעותר מס' 2 "בבחינת ידיד קרוב".

3.על החלטה זו הגישה המדינה בקשת רשות ערעור לבית המשפט המחוזי (רע"א 54912-11-12) מן הטעם שהעותר 1 אינו עורך דין ואינו מוסמך לייצג את העותר 2. בבקשה נטען כי העותר 1 מרבה להגיש תביעות נגד המדינה ונגד עובדי מדינה, ונראה כי הוא מוצא לנכון לייצג תובעים שונים.

בהחלטתו מיום 2.1.2013 הורה בית המשפט המחוזי על ביטול החלטתו של בית משפט השלום ועל החזרת העניין לבית משפט השלום, על מנת שידון במכלול השאלות העולות מהבקשה.

4.בהחלטתו מיום 14.1.2013 חזר בית המשפט ובחן את העניין, ומצא כי העותרים לא הצביעו על "הוראה מפורשת אחרת" שמכוחה רשאי העותר 2 להיות מיוצג על ידי העותר 1 תוך עקיפת הוראת תקנה 472.

5.בעקבות החלטה זו, פנו העותרים לבית משפט השלום, בבקשה לעיכוב הליכי התביעה עד להגשת עתירה לבג"ץ לביטול תקנה 472. בהמשך, פנו העותרים לבית משפט השלום בבקשה לבטל החלטתו מיום 14.1.2013 ולחזור ולעיין בה, מאחר שבפני בית המשפט לא הונחה עמדת העותרים לפיה סעיף 5 לחוק השליחות, התשכ"ה-1965, הוא בבחינת "הוראה מפורשת אחרת" לצורך תקנה 472 לתקנות. עוד נאמר בבקשה, כי בית המשפט מוסמך לבטל תקנה, וכי טרם נשמעה עמדת העותרים לגבי חוקיותה של תקנה 472, אשר לטענתם הותקנה בחוסר סמכות.

בהחלטתו מיום 21.2.2013, הורה בית משפט השלום כי הבקשה תידון במועד הדיון הקבוע ליום 20.5.2013.

6.נספר כי ביני לביני, פנה העותר במכתב מיום 11.10.2012 אל שר המשפטים, בדרישה לבטל את תקנה 472. העותר נענה כי מכתבו נתקבל, אך 3 תזכורות ששלח בעניין זה לא נענו.

7.בעתירה דכאן, מבקש העותר להורות למשיב ליתן טעם מדוע לא תבוטל תקנה 472 וליתן צו ביניים המורה לבית משפט השלום להמשיך בניהול התובענה כשהעותר 2 מיוצג על ידי העותר 1.

8.דין הבקשה להידחות, בשל אי מיצוי הליכים ומאחר שבפני העותרים עומד מסלול חלופי.

הבקשה שהגישו העותרים לבית משפט השלום אמורה לידון ביום 20.5.2013, וכפי שציינו העותרים עצמם בבקשתם לבית משפט השלום, ניתן לתקוף את חוקיותה של התקנה בתקיפה עקיפה, שיתרונותיה עמה, באשר היא מאפשרת ליתן הכרעה מושכלת על פי נתונים קונקרטיים העומדים בפני בית המשפט. ככלל, סמכותו של בית בית המשפט הגבוה לצדק לדון בטענות לגבי אי חוקיות תקנה, אינה מונעת דיון בתקיפה עקיפה בבית משפט "רגיל" ביוזמתו של בעל הדין שיזם את ההליך ולא כטענת הגנה, ואפשרות זו מקימה לעותר סעד חלופי (ראו, לדוגמה, בג"ץ 3429/11 בוגרי התיכון הערבי האורתודוקסי בחיפה נ' שר האוצר בפסקה 34 והאסמכתאות הרבות הנזכרות שם (5.1.2012)).

בנושא קרוב לענייננו, אפנה לבג"ץ 6090/08 ברגר נ' שר המשפטים (11.8.2008) שם נדונה עתירה כנגד חוקיותן של תקנה 2(א) ותקנה 14 לתקנות בית המשפט (אגרות), התשס"ז-2007. העתירה נדחתה בשל קיומו של סעד חלופי של תקיפה עקיפה של חוקיות התקנות בפני רשם בית משפט השלום. וכך נאמר שם:

אין בקיומה של אפשרות של "תקיפה ישירה" כדי להביא בהכרח לכך שתבוטל הדרך של "תקיפה עקיפה". ואכן, ערכאות דיוניות מבצעות "תקיפה עקיפה", הגם שיש לבעל דין אפשרות עקרונית להגיש עתירה לבית המשפט הגבוה לצדק. במקרה דנא נעשית "התקיפה העקיפה" על ידי בעל הדין שיזם את ההליך ולא על ידי בעל הדין המתגונן. חובה להדגיש, כי גם במצב דברים כזה אין מניעה שבית המשפט הרגיל ידון בטענה המופנית נגד המעשה ...

[ ] ...אפשרות של "תקיפה עקיפה" של פעולה מינהלית מקימה לעותרים סעד חלופי (ראו, בג"ץ 1431/05 אוריאן נ' שר התחבורה (לא פורסם, 7.7.2005)). הלכה פסוקה היא כי בית משפט זה לא יידון בעתירה כל עוד עומד לעותר סעד חלופי (ראו, בג"ץ 3515/07 ניסנוב נ' שר המשפטים (לא פורסם, 29.4.2007); בג"ץ 3048/07 מזרחי נ' רשם האגודות השיתופיות (לא פורסם, 01.07.2007)).

והדברים יפים לענייננו.

9.אשר על כן העתירה נדחית. לפנים משורת הדין, ומאחר שלא נתבקשה תשובה, אין צו להוצאות.
