השופט ד' חשין:

1.בעתירה זו מבקשים העותרים כי נורה למשיבים ליתן טעם מדוע לא יבוטל תוקף האישור שניתן לתוכנית מאושרת מס' 52/26 (להלן – התכנית) להקמת מחצבה במערב הר חברון (להלן – המחצבה); ולחלופין, מדוע לא יושעה תוקף התכנית עד להגשת תכנית מתוקנת, שתבטיח את חייהם, בריאותם ורכושם של העותרים, ולאחר שיתאפשר להם לעיין בה.

2.העותרים הנם חמישה אחים. משפחותיהם, המונות 39 אנשים, מתגוררות בקרבת המחצבה, "בתוך שטח ההשפעה" שלה, לטענתם. העותרים גרים במספר מבנים, חלקם מבני אבן וחלקם עשויים ברזל ועץ. לדבריהם, חלק מהמבנים קיימים מזה עשרות שנים.

המשיבה 1 הינה מועצת התכנון העליונה – ועדת המשנה לכרייה וחציבה המנהל האזרחי, אזור יהודה ושומרון בית אל. המשיבה 2, טללים בנגב הצחיח בע"מ, הינה חברה פרטית שקיבלה את הזיכיון להקמת המחצבה.

3.בשנת 1994 החלו הליכי התכנון של התכנית. ביום 1.6.94 אושרה הפקדת התכנית, להקמת מחצבה על ידי המשיבה 2. אביהם של העותרים, כמו גם אחרים, הגישו התנגדויותיהם לתכנית שהופקדה. לאחר שהתנגדויות אלה נדחו, הגיש אבי העותרים ל בית משפט זה עתירה, שאוחדה עם עתירות אחרות באותו עניין (להלן – בג"ץ 3055/95). ביום 27.11.97, לאחר שהתכנית שונתה נוכח המבנים המאוכלסים, ולאור התחייבות המשיבה 2 לבצע השלמות שנדרשו על ידי מוסדות התכנון, ולאחר שהוצהר כי עם קבלת ההשלמות יקבלו גופי התכנון החלטתם בהקדם, דחה בית המשפט את העתירה, בקובעו כי "העותרים באו על סיפוקם". בית המשפט הוסיף בפסק הדין: "אנו רושמים לפנינו, כי אם לא תתקבל החלטה על ידי הרשויות המוסמכות לענין התכנית המתוקנת תוך שישה חודשים, העותרים שומרים על זכותם לפנות ל בית משפט זה; רשמנו הצהרת מר שפר כי העותרים יוכלו לעיין במסמכי התכנית החדשה".

הליכי התכנון נמשכו, ובכלל זה דיונים בהתנגדויות שונות שהוגשו על ידי מי שאינם העותרים שלפנינו (להלן – העותרים האחרים). בשנת 2001 אושרה התכנית למתן תוקף. בעקבות זאת, הגישו העותרים האחרים ערר לוועדת העררים (ערר 7/02), ומשנדחה, הגישו גם עתירה ל בית משפט זה (בג"ץ 1038/05). בהתנגדותם ובעתירתם תקפו העותרים האחרים את התכנית בעניינים הנוגעים למחצבה, לתכנונה ולשטח דרך הגישה אליה. ביום 20.9.06, בעקבות הערות בית המשפט, משכו העותרים האחרים את עתירתם.

4.בעתירה שלפנינו טוענים העותרים, כי יש בתכנית כדי לסכן את חייהם, בריאותם ורכושם, בעיקר כתוצאה מהדף הפיצוצים, הצפויים להתרחש במרחק של 250 מטרים ממגוריהם. לטענתם, התכנית אושרה אמנם בשנת 2001, אך חרף התיקונים שהוכנסו בה, לא הועמדה לעיונם של העותרים ולא פורסמה להתנגדויות. לדבריהם, עד לאחרונה לא נודע להם דבר על עצם קיומה או אישורה. הם מוסיפים, כי תסקיר ההשפעה על הסביבה המתוקן שהוגש הינו מוטעה ואינו נותן את הרושם המלא בנוגע להשפעות הסביבתיות, ביניהן בנושא רעש ואבק, והתעלמות מהשפעת הפיצוצים על בורות מים בסביבה ועל משק החי של העותרים.

המשיבים סבורים כי דין העתירה להידחות על הסף. זאת, הן בשל השיהוי הרב שבהגשתה והן מחמת אי ניקיון כפיהם של העותרים, המחזיקים במבנים שנבנו ללא היתר. כן טוענים המשיבים, כי יש לדחות את העתירה לגופה, בנימוק כי טענות העותרים כבר נידונו בידי מוסדות התכנון וכי אין מקום לפתוח את הליך התכנון מחדש. לדבריהם, לא היה צורך בהפקדתה החוזרת של התכנית, משום שהשינויים שנעשו בתכנית המקורית אינם כה גדולים, בהוסיפם כי במסגרת בג"ץ 3055/95 לא התחייבו להפקיד את התכנית מחדש. כן טוענים הם, כי עיקרי התכנית כבר נדונו בפני בית משפט זה (בג"ץ 3055/95), שם צוין, כזכור, כי העותרים כבר באו על סיפוקם. המשיבה 2 מוסיפה וטוענת, כי עתירה זו הינה חלק ממסע כולל שמנהלת נגדה מחצבה אחרת, החפצה להמשיך ולהיות המונופול בשטח.

העותרים, מצדם, טוענים כי אמנם נכון שהעתירות הקודמות בעניין נדחו בידי בית משפט זה, אך נקבע כי יתאפשר לעיין בתכנית המתוקנת. כן מציינים הם, כי המשיבים אינם טוענים שכל המבנים אינם חוקיים, אלא טוענים כן רק ביחס לאחדים מהם. העותרים מכחישים כי המחצבה האחרת היא העומדת מאחורי עתירתם.

5.לאחר ששמענו את טענות הצדדים, באנו למסקנה כי דין העתירה להידחות.

ראשית, מקובלת עלינו טענת השיהוי. התכנית אושרה כבר בשנת 2001. העתירה הוגשה רק ביום 17.12.06. העותרים טוענים כי אך "לפני זמן קצר" (מבלי לציין מתי בדיוק) נודע להם על התכנית המתוקנת. מתקשים אנו לקבל טענה זו. בשנת 1997 נתן, כאמור, בית משפט זה פסק דין שבו דחה את עתירתו של אבי העותרים (בג"ץ 3055/95). בית המשפט קבע, כזכור, כי לעותרים באותה עתירה (שהיו מיוצגים) יתאפשר לעיין בתכנית המתוקנת. קשה אפוא לקבל את טענתם כי לא ידעו כלל שיש תכנית מתוקנת, והרי יכלו לפנות מיוזמתם לגורמי התכנון ולבדוק את התקדמות הליכי התכנון. משלא עשו כן, יש בעיתוי הגשת עתירתם – מעל חמש שנים לאחר שאושרה התכנית המתוקנת, ולמעלה משמונה שנים מעת מתן פסק הדין בבג"ץ 3055/95 – משום שיהוי רב וכבד, כטענת המשיבות.

שנית, יש לדחות את העתירה גם לגופו של עניין. כלל הוא, כי בית משפט זה לא שם עצמו בנעליהן של רשויות התכנון ואינו מתערב בשיקול דעתן, אלא במקרים חריגים וקיצוניים, כגון חריגה מסמכות, חוסר תום לב או חריגה קיצונית ממתחם הסבירות (ראו, לאחרונה, בג"ץ 2389/04 בשאראת נ' המפקד הצבאי באיזור יו"ש, ניתן ביום 10.12.06, פסקה 5). לא מצאנו בסיס לטענת העותרים בדבר חריגה קיצונית כזו. יצוין, כי העותרים נמנעו מלצרף לעתירתם חוות דעת מומחה שתבסס את טענותיהם. אפילו היו מגישים חוות דעת התומכת בטענותיהם, לא היה בכך בהכרח כדי להביא לביטול התכנית. מכל מקום, חוות דעת מעין זו הייתה צריכה להיות מוגשת לגופי התכנון, בהיותם הגורמים המקצועיים שהופקדו על כך. בתורת שכאלה, הם שקובעים, על פי החומר המצוי בפניהם, את מידת המפגעים הסביבתיים שעלולים להתרחש כתוצאה מתכנית, כמו גם את האופן בו יש למנעם או למזערם. אף בעניין זה, רק החלטה חריגה שאינה סבירה באופן קיצוני יכולה להביא להתערבות בית משפט זה בהליך התכנוני.

ואחרון, ראינו להזכיר, כי גם לאחר מתן תוקף לתכנית, ואף לאחר שיונפקו היתרי בנייה, יחולו על המשיבה 2 כל הוראות הדין המחייבות אותה לעמוד בכל הדרישות הנוגעות להיבטים הסביבתיים ולמניעת מפגעים, הן בפן התכנוני והן בפן הפלילי (וראו סעיפים 51-50 לתגובת המשיבה 1 לעתירה).

6.העתירה נדחית. ממילא, צו הביניים מבוטל בזה. בנסיבות העניין אין צו להוצאות.
