39. תלונות שבירורן מצריך סיבה מיוחדת
תיקון: תשל״א
ואלה תלונות שלא יהיה בהן בירור, אלא אם מצא נציב תלונות הציבור שיש סיבה מיוחדת המצדיקה את בירורן:
(1)תלונה בענין שניתנה בו החלטה שעליה אפשר, או היה אפשר, להגיש על פי דין השגה, ערר או ערעור, והוא אינו מסוג הענינים שסעיף 38(5) דן בהם;
(2)תלונה שהוגשה לאחר שעברה שנה מיום המעשה שעליו נסבה התלונה או מהיום שהמעשה נודע למתלונן, לפי המאוחר יותר.
