תיקון: תשל״ז
הפטורים כאמור בסעיפים 1 ו־2 יינתנו בתנאי שתוך שלושה חדשים לפני העברת הזכויות כאמור, או תוך ששה חדשים לאחר ההעברה, קיבל האיגוד החלטה לפירוקו, או שנמחק מפנקס החברות, בהתאם להוראות סעיף 242 לפקודת החברות, תוך ששה חדשים לאחר ההעברה כאמור; מנהל מס שבח מקרקעין רשאי להאריך את התקופה למחיקת האיגוד מפנקס החברות בששה חדשים נוספים אם הוכח להנחת דעתו כי המחיקה טרם בוצעה מסיבות שאינן תלויות באיגוד.
