5. היתר למינוי ולהמשך העסקה של קרוב משפחה במטה הקבוע
על אף האמור בסעיף 3(1) ו־(2), רשאי האחראי לתת היתר להעסקת קרובי משפחה, ורשאי הוא להתנות היתר כאמור בתנאים שיראה לנכון, בהתחשב בשיקולים המפורטים בסעיף 4(א) לכללי שירות המדינה, אם שוכנע כי העסקה כאמור לא תפגע בטוהר המידות.
