9. הענקה חדשה
(א)מפיק או ספק, שהתחיל להפיק או לספק מים לאחר כ״ח באדר ב׳ תשל״ג (1 באפריל 1973), לא יהיה זכאי להענקה, אלא אם נציב המים אישר מראש את מטרת ההפקה או ההספקה כחיונית וכמצדיקה מתן הענקה, על סמך בקשה שהוגשה לו מאת המפיק או הספק, לפני תחילתה של אותה הפקה או הספקה.
(ב)מפיק או ספק שלא קיבל בעבר הענקה ושינה את מערכת הפקת המים או מערכת הספקת המים לאחר כ״ח באדר ב׳ תשל״ג (1 באפריל 1973), יראוהו כאילו התחיל להפיק או לספק מים, כאמור בתקנת משנה (א).
