3. תנאים לשימוש במיתקנים קיימים
ראש הגא לא ישתמש במיתקנים קיימים שבמקרקעין אלא אם נתקיימו אלה:
(1)ניתנה למחזיק במקרקעין הודעה מוקדמת של יום אחד לפחות;
(2)הותקנו באותם מקרקעין מיתקנים נוספים;
(3)זכות השימוש במיתקנים הקיימים של המחזיק במקרקעין לא תיפגע במידה העולה על זו שהיא, לדעת ראש הגא, הכרחית בנסיבות המקרה.
