4. תנאים למתן היתר
(א)לא יתן המנהל היתר אלא אם נתקיימו במבקש שני אלה:
(1)הוא כשיר להפעלת התכשיר לפי תעודה שהמנהל הכיר בה;
(2)הוא המציא ערובה, להנחת דעתו של המנהל, לכיסוי נזק העלול להיגרם משימוש בתכשיר לבני אדם, לבעלי חיים, לצמחים או לסביבה.
(ב)אין בהמצאת ערובה כדי לפטור את המבקש מאחריותו למלוא הנזק שגרם כאמור.
