9. ביטול ערעור
עד למתן פסק־הדין בערעור רשאי המערער לחזור בו מערעורו על ידי מתן הודעה בכתב לבית המשפט והמצאת העתק הימנה למשיב, או על ידי הודעה בעל־פה בשעת שמיעת הערעור; משנעשה כן, בטל הערעור, והמערער ישלם למשיב על פי בקשתו את ההוצאות שיקבע בית המשפט.
