9. בנין שאינו חדש
(א)היה הדיור החלוף בבנין שאינו חדש, תהיה הדירה במצב אחזקה תקין והבנין יהיה יציב וראוי למגורים על פי אישור מהנדס הרשות המקומית המעוניינת.
(ב)היה מהנדס הרשות המקומית המעוניינת סבור שלפני מסירת הדיור החלוף יש לבצע בו שיפוצים, יתן על כך הודעה בכתב לרשות והרשות תגרום לביצוע השיפוצים האמורים לפני מסירת הדירה כדיור חלוף.
