Section 2 of תקנות הכשרות המשפטית והאפוטרופסות (השקעת כספים בידי אפוטרופוס או מיופה כוח), התשפ״ד–2024, הנחיות מקדימות.
2. הנחיות מקדימות
(א)הורה בית המשפט לאפוטרופוס לענייני רכוש לפעול לפי הנחיות מקדימות שנתן האדם בעניין השקעת כספיו, יפעל האפוטרופוס לפי ההנחיות המקדימות.
(ב)נתן האדם בייפוי כוח מתמשך הנחיות מקדימות בעניין השקעת כספיו, יפעל מיופה הכוח לפי ההנחיות המקדימות, בכפוף לסעיפים 32לא ו־32לב לחוק.
(ג)בהעדר הנחיות מקדימות כאמור בתקנות משנה (א) או (ב), יפעל האפוטרופוס או מיופה הכוח, לפי העניין, לפי תקנות אלה.
