Section 1 of הודעה בדבר תנאים לתשלום גימלה לרגל פרישתו של חייל לפני תחילת החוק.
1.
(א)נפטר חייל בזמן שירות קבע, זכאים שאיריו לגימלה אם הוא שירת בשירות קבע לפחות 5 שנים או אם שאיריו זכאים מחמת פטירתו לתגמולים לפי חוק משפחות חיילים שנספו במערכה (תגמולים ושיקום), תש״י–1950.
(ב)נפטר חייל בזמן שירות קבע ואין שאיריו זכאים לגימלה לפי סעיף קטן (א), ישולם לשאיריו לרגל פטירתו מענק כאמור בסעיף 24 לחוק.
