3. חובת שימוע
(א)הגיע לידי השר מידע שיש בו כדי להעיד על התקיימותן של עילות הגירוש על ידי בן משפחה של מחבל, יזמן השר את בן המשפחה לשימוע שיתקיים בתוך עשרה ימים ממועד הזימון; במהלך השימוע תינתן לבן המשפחה האפשרות לטעון את טענותיו והוא יהיה זכאי לייצוג משפטי.
(ב)לאחר השימוע כאמור בסעיף קטן (א) ולא יאוחר מתום 14 ימים ממועד השימוע, ימסור השר את החלטתו כאמור בסעיף 2, ואם החליט לגרש את בן המשפחה של המחבל – יחתום באותו מועד על צו הגירוש.
