4. הסמכות להטיל עונש מוות
סמכותו של בית משפט להטיל עונש מוות בעבירות לפי חוק העונשין, התשל"ז-1977 ולפי חוק בדבר מניעתו וענישתו של הפשע השמדת עם, התש"י-1950, לא תותנה בכך שהתביעה ביקשה לגזור עונש כאמור או תמכה בהטלתו.
