3. הפעלת מכונות
על אף האמור בתקנות מניעת רעש, בתקנות רעש בלתי סביר ובתקנות אחרות לפי חוק למניעת מפגעים, לשם ביצוע עבודות להקמת מיזם תשתית חיוני מועדף, גוף מבצע רשאי להפעיל מכונה כמשמעותה לפי החוק האמור או לבצע כל עבודה לצורכי חפירה, בנייה, הריסה או כיוצא בהן, באזור מגורים, בכל שעה משעות היממה, ובלבד שהפעלת המכונה או ביצוע העבודה אינם כרוכים בגרימת רעש חזק או בלתי סביר כאמור בתקנה 2.
