תקנה 3(2) לא תחול על מיתקן גפ״מ שבמועד פרסום תקנות הסדרים במשק המדינה (תיקוני חקיקה להשגת יעדי התקציב והמדיניות הכלכלית לשנת הכספים 2001) (כללים לעניין החזקת מלאי גפ״מ), התשפ״ו–2026 (ביום 13.7.2026), היה לו היתר הפעלה מאת מנהל ענייני בטיחות הגז.
