177. חזקת נישואין

מי שהיה נשוי הוא בחזקת נשוי, לענין סעיף 176, כל עוד לא הוכיח שנישואיו הקודמים בוטלו או הופקעו, בין על ידי מות בן הזוג ובין על פי פסק דין סופי של בית המשפט או של בית הדין המוסמך או על פי דין התורה בדרך שאישר בית הדין המוסמך, ואין רואים אותו כפנוי אלא משעת המוות או משעה שניתן פסק הדין או האישור כאמור.
