2. ענישה לפי חקיקת משנה
תיקון: תשנ״ד־3, תשפ״ב־2
(א)הסמכות להתקין תקנות לביצוע חוק, כוללת אף את הסמכות לקבוע עבירות על התקנות ועונשים על עשייתן; ואולם, עונש מאסר שנקבע בתקנה, תקופתו לא תעלה על ששה חודשים, ואם נקבע עונש קנס – לא יעלה שיעורו על הקנס שניתן להטיל בשל עבירה שעונשה הוא קנס שלא נקבע לו סכום.
(ב)תקנות שבהן נקבעו עבירות ועונשים, למעט חוקי עזר של רשות מקומית, טעונות אישור ועדה של הכנסת.
