עובד הציבור שיש לו מכוח משרתו סמכות שיפוטית או מינהלית לגבי נכסים מסוג מסויים או לגבי עיסוק בחרושת, במסחר או בעסק מסוג מסויים, והוא משתמש בסמכותו לגביהם בין בעצמו ובין על ידי אחר כשיש לו, במישרין או בעקיפין, זיקה פרטית בהם, דינו – מאסר שלוש שנים.
