לא יישא אדם באחריות פלילית למעשה שנצטווה לעשותו תוך איום שנשקפה ממנו סכנה מוחשית של פגיעה חמורה בחייו, בחירותו, בגופו או ברכושו, שלו או של זולתו, ושאנוס היה לעשותו עקב כך.
