מי שנידון למאסר תיחשב תקופת מאסרו מיום גזר הדין, אם לא הורה בית המשפט הוראה אחרת; היה הנידון משוחרר בערובה אחרי גזר הדין, לא יבואו ימי שחרורו במנין תקופת העונש.
