שופט רשאי להתפטר מכהונתו בהגשת כתב התפטרות לשר המשפטים; כהונתו תיפסק בתום שלושה חדשים מהגשת כתב ההתפטרות אם לא הסכים שר המשפטים למועד קצר יותר.
