לא יגיש נאשם לבית המשפט חוות דעת בכתב או תעודת רופא ולא ישמיע עדות מומחה שלא קויים לגביהן צו שניתן לפי סעיף 83, אלא בהסכמת התובע או ברשות בית המשפט.
