2. סמכות ענינית
הסמכות הענינית לדון בענין שחוק זה דן בו תהא נתונה –
(1)כל עוד לא הוגש כתב אישום – לבית משפט השלום;
(2)לאחר הגשת כתב אישום – לבית המשפט המוסמך לדון בכתב האישום;
(3)בערעור – לבית המשפט שלערעור.
